Attached is the agenda for the hearing at the Building Inspection Commission this Wednesday, November 20 at 9:30 am which includes the proposed Supervisor Rafael Mandelman’s ordinance to repeal the ABE ordinance, see item #4.
The ABE ordinance has been in effect since 2017. There have been extensions until this December, when the last extension will sunset. The City will commence sending notices to owners of properties who have not complied to appear at a directors hearing at which time they may be granted around 90 days to comply with the ordinance. Although at this time there is no penalty, the City will apply a monthly monitoring fee and an Order Of Abatement may be recorded against the property.
To comply with the ABE ordinance the costs can be as high as $70,000, and more, as DPW in some cases has required the sidewalk to be rebuilt to meet DPW code. There are some cases where CASp inspectors have called for accessibility for buildings that are not public.
I believe the city attorney had sued some lawyers for filing frivolous lawsuits and since then I am not aware of any drive by lawsuits being filed.
