Please join us for our annual Moot Court Finals, where two UCI Law students will present oral arguments to a panel of distinguished federal judges.This year the competition will take place at the Beckman Center, and we are looking forward to once again hosting the competition in person.
Case Summary/Questions Presented:
In this case, the petitioner, a former medical professor at a public university, claims she was fired in retaliation for a blog entry she posted on her non-university-hosted website. Her former employer issued a press release that the petitioner claims damaged her reputation and made it impossible for her to subsequently find employment. Her former employer asserts that the petitioner’s speech was not subject to First Amendment protection and that she was not deprived of a liberty interest in her reputation. The court will decide this case of first impression, which presents two legal issues:
- By issuing the press release, did the employer infringe petitioner’s liberty interest in her reputation under the Fourteenth Amendment?
- By firing the her for statements made on her blog, did the employer violate the petitioner’s free speech rights under the First Amendment?
