Important PSA: Make sure your sales board is publicly visible.

We mentioned this last month, but it’s really important — especially if a DMV inspector visits your dealership. So, please, consider this an important Public Service Announcement.

 

Please make sure that your sales board is in a location that is both visible and accessible to the general public at all times, not just for your staff or select visitors to your dealership (for example, in a break room or behind the sales tower).

 

This board must contain all salesperson licenses (they look similar to California Driver Licenses, but are vertical) used at your dealership, and each one must be up-to-date and accounted for.

 

If you need to add, update, edit, or remove licenses, as well as if you have any questions that need answering, everything you may need is located on California DMV's website, here.

Did you know that you can reach out to your Account Executive to have them analyze the DMV fees in your DMS (Dealer Management System) assessed on the vehicles you sell? They can work with you to assess, and in most instances update, the way your DMS rates the vehicles that you sell. Let us work with you to improve the accuracy of your fees so that you're not over- or under-collecting DMV fees unnecessarily. Simply contact your Account Executive to schedule a DMV fee analysis — it’s complimentary.

DMVdesk makes it easy to keep track of all the dates and deadlines to submit paperwork. But what if you just wanted to look up the due dates and timelines outside of DMVdesk? And what if it was a wheel — that you can spin?! You all know and love the California Submission Due Date Calculator Calendar Wheel that tells you exactly what is due and when.

Our fee estimates and checklists are created to be dynamic based on the information you enter in Vitu. The more accurate the information you enter, the more accurate your fee quote and checklists are.

 

Additional Tips

If an item is asked for in the Sale Info section, it is taxable in the titling state. 

 

Common items that can affect fees include:

  • Vehicle weights
  • MSRP
  • Customer’s Date of Birth
  • Fuel Type
  • MPG

Please make sure you enter the correct information so that your dynamic checklists are as accurate as possible.

New form required for NY lien satisfactions.

New York recently implemented a new form which you may see soon — the New York State Department of Vehicles Title or Lien Status Report (MV-913). This form can be used as proof that a lien was satisfied only when presented along with the original New York State title issued on the Title Issuance Date. 

 

Only active liens are shown on this form. Any lien printed on a New York Certificate of Title (MV-999) issued prior to the MV-913 print date has already been released electronically, and a separate lien release is not required as evidence that the lien has been satisfied.

 

We’ve attached a sample MV-913 below for your reference. If you have any questions about the MV-913, you can reach New York State DMV at (518) 474-3785 between the hours of 8:30 a.m. to 4:15 p.m. Monday through Friday.

A Colorado POA reminder.

As a reminder, the state of Colorado does not allow your dealership to sign as a POA (Power of Attorney) for the buyer — even with a secured POA. The purchaser's signature on the title reassignment or the odometer section on the back of the MCO (Manufacturer’s Certificate of Origin) should be left blank if the customer is unable to sign it. We here at Vitu will then sign it by POA when it reaches our final audit team.

Delaware “Dealer License” tips.

As it stands, the "Dealer License" is a possible form on the checklist for Delaware transactions. However, it appears that some may be overlooking this item or are not clear on when it is required. 

 

If your dealership's name or address is inconsistent on any of the documents, the state of Delaware requires a copy of the Dealer License to be submitted with the names/addresses listed.

NTX News
A very important note for Florida-titled vehicles.

It has been brought to our attention that the state of Florida will not acknowledge a newly issued Montana Title, if the document provided to NTX to process the transaction was an E-Title (MVR).

 

AAMVA (American Association of Motor Vehicle Administrators) regulations, which comply with both Federal and State jurisdictions, state that an E-Title is the most efficient solution that aims to facilitate a secure electronic titling process that no longer relies on physical paper. 

 

Unfortunately, the State of Florida has implemented its own regulations stating that an electronic title is not an effective document if a physical Florida title has not been printed first. Since they are not recognizing the FL MVR as the document of truth, they are stating that the new Montana title is invalid and their Florida title is still the most current title.

 

We’re here to help with a temporary work-around

NTX and the State of Montana are currently working with the State of Florida to come up with a comprehensive decision that will allow Florida MVRs to be used. However, in the meantime, we ask that:

If you are processing a transaction that is currently titled in Florida, print a paper title before you begin your NTX transaction. 

If you would like Vitu to request a printed Florida title, we will gladly do so — just upload a POA (Power of Attorney) signed by the current title owner appointing Vitu in order to request for a title on their behalf. The Florida title print fee is $10 and is invoiced separately from the NTX transaction. If you have any questions, please contact your Account Executive for assistance.

Now required: Seller’s phone number.

Due to changes in NIST (National Institute of Standards and Technology) Level 2 requirements, after March 7th, 2024, when using the Digital Transfer Form (MV212), entering the seller's phone number is required.

 

All you have to do is enter this in the Daytime Phone # field in the Transfer Section under the Seller.

Once everything is ready for digital signatures, have your customer open the link sent to them with their mobile phone. They will need to take a picture of their Driver License, and a live scan of their face. The process only takes a minute, is easy and kind of fun.

New Feature — Resend for Signature.

Let’s say your customer failed to sign their Digital Transfer Form (MV212) by the end of the day — what to do? Now you can just click the blue Resend for Signature button to resend the Digital Transfer Form to your customer, as long as it is still within a 3-day window of the transaction.

When the Digital Transfer Form popup appears, select the Resend button.

The Digital Transfer Forms that are not signed by Seller(s) will expire at the end of the third day from the day the initial links were sent. Transactions with an expired sign ceremony will automatically transition to an Issue Found status. Once in an Issue Found status, you can go back into the transaction, click Edit and transition through the pages to Resend the document for signature again.

Enter the proper Vehicle Type and Ton Code.

When filling out the required fields within your transaction, it is extremely important to select the correct Vehicle Type in that dropdown. For a truck, if you select Passenger, Van or Rugged Terrain, Vitu’s Audit Team will return the transaction. If the vehicle is in fact a pickup truck, you must select Truck in the dropdown so that the Ton Code field appears.

From the Ton Code dropdown menu, select the appropriate tonnage in relation to the pickup truck. Remember that NTX is only authorized to process Passenger cars and Light Duty Trucks. Light duty is defined as 1 ton or less.

Any truck over 1 ton is considered a Commercial vehicle and NTX is not approved to title these. Anything submitted over 1 ton is not acceptable for processing and will be canceled by the auditor. 

Odometer Date Read and Purchase Date.

Please remember that there are two date fields that are very important in the audit process: 

  • Date Read field in the Odometer Information section  
  • Purchase Date in the Seller Info section

The Purchase Date CANNOT be more recent than the Odometer Date Read.
