Zoom Meeting with MSP Licensing Division

Dear John,


The Supreme Court ruled that New York's law requiring "proper cause" as a prerequisite for a permit to carry a firearm is unconstitutional under both the 2nd and 14th Amendments of the United States Constitution. The 2A community is alive with speculation.


While the ruling will likely impact existing Maryland law; at least for the moment, nothing has changed. Until the MSP have guidance from the Maryland AG, prematurely inundating the Licensing Division with new permit applications will only bog down their system.

California Attorney General Issues Legal Alert - Advises Compliance While Suggesting Various Means of Defiance

The first page reads as though the California AG is simply advising the LEOs to comply. Pages 2 and 3 are a thinly disguised advisory on how to get around the SCOTUS ruling by requiring “proof” of good moral character. It goes on to describe the patchwork quilt of standards used by various agencies in California. If anything, the statement on page 3: “It is reasonable to consider such factors in evaluating an applicant’s proof of the requisite moral character (emphasis mine) to safely carry firearms in public.” coupled with the suggested standards used by Riverside County’s Sheriff’s Department is going to generate a firestorm of issues. That is “good cause / good and substantial” on steroids.

 

Maryland has the unfortunate tendency to mimic what California does regarding firearms regulations. If the Maryland legislature opts to follow this path, the net result is going to be a nightmare.


We should not be surprised if the usual suspects in the Maryland General Assembly attempt to obstruct the SCOTUS decision by sponsoring onerous legislation designed to make it nearly impossible to meet training requirements, license fees that few could afford and whatever else they can dream up.

New York State Rifle & Pistol Association v. Bruen

Held: New York’s proper-cause requirement violates the Fourteenth Amendment by preventing law-abiding citizens with ordinary self-de- fense needs from exercising their Second Amendment right to keep and bear arms in public for self-defense.
