Happy Summer, ACC Charlotte Members!
I hope you are each enjoying a wonderful and relaxing start to your summer. While school may be out for summer, ACC Charlotte remains in full gear offering lots of opportunities for engagement.
This past quarter has been fabulous and I have enjoyed seeing so many of you at our events. Our members have enjoyed professional development, informative CLEs, driving go-carts, pickleball, wine tastings, and the opportunity to give back by building bears for the children of Levine Children’s Hospital. Our events have been super exciting, super diverse and super packed! The events have taken me to new places in Charlotte and expanded my personal and professional networks.
Speaking of networks, the ACC Charlotte Chapter currently boasts more than 770 members and continues to grow. If you know of any in-house lawyers who are not currently a member, please encourage them to join us and make the most of our in-house community.
We recently launched the ACC Charlotte Member Survey and prize. Please take a moment to complete the survey and let your voice be heard. I just finished mine and it took less than five minutes.
If you are looking to become more engaged, let us know. We will soon be looking to fill open committee chair positions and open board seats. Feel free to reach out to any member of the board to discuss your interest and find out more about service to our chapter.
Get ready to roll the dice and give back to the community at our annual Casino Night on Saturday, August 17, 2024. This year we will gather at Quail Hollow Club and dress our best in tribute to the Great Gatsby. The Casino Night invitation is set to launch on Monday, July 15th and will fill quickly. Don’t miss your opportunity to be a part of this spectacular social event of the year!
I look forward to seeing each of you soon. In the meantime, I hope you find time to relax and enjoy some time away from the office to recharge.

The Supreme Court’s Affirmative Action Ruling: Ramifications for All Employers

The Supreme Court of the United States’ ruling on the use of affirmative action in college admissions has major implications beyond the higher education setting and will impact employers with diversity, equity, and inclusion (DEI) programs; federal contractor obligations; and environmental, social, and governance (ESG) practices. This session examined the case and provided guidance on actions employers may want to consider to ensure their DEI practices are successful and compliant under Title VII of the Civil Rights Act of 1964. The speakers also discussed the potential for an increase in complaints and litigation alleging that such programming is unlawful.

In the past year, Congress passed the PUMP Act and the Pregnant Workers Fairness Act, and the Supreme Court issued its decision in Groff v. DeJoy on religious accommodations. To make matters more confusing, a Texas District Court Judge partially blocked the PWFA. This presentation discussed the challenges ahead and provided practical tips on how to manage accommodation requests going forward and how to comply with changes in the law relating to pregnancy accommodations and religious accommodations in light of the new federal statutes and Supreme Court precedent.

2024 Employment Law Update

2023 was defined by large-scale legislation on issues relating to pregnancy, childbirth, and sexual harassment. 2024 has ushered in a return to political gridlock and, as a result, led to more executive action on issues like restrictive covenants, workplace safety, and the FLSA. Key judicial opinions have also shifted the employment landscape by, among other things, adopting a new test for religious accommodation requests. And, seemingly hovering over everything in 2024 is the promise and threat of AI, and the guidance, regulations, and legislation intended to constrain it. Keith Weddington and Tory Summey of Parker Poe provided an update on Employment law and an overview of the current legal landscape facing employers. They reviewed recent case law developments from the Supreme Court, Fourth Circuit and North Carolina state courts and addressed new federal legislation providing additional protections to workers. They also covered new guidance, regulations, and enforcement priorities at the agency level, including the NLRB, OSHA, EEOC, FTC, and DOJ.
