Thank you to our Harris County family court judges! The judges held a meeting Monday afternoon after my last newsletter went out and they adopted a new set of UNIFORM procedures that apply to all ten family courts while the pandemic is still upon us.
Highlights of these new uniform procedures include:
These procedures expire on May 8 unless extended.
Unsworn declarations can be used in lieu of affidavits to prove up agreements.
The list of hearing types that will be heard on submission has been expanded.
Very specific instructions for hearings by submission are provided.
Each court will post its own policies on Zoom hearings. Some courts will use this option more than others. Most experienced lawyers agree with me that Zoom cannot work for contested cases involving non-party witnesses and many exhibits.

I may not win every case (even if in my heart I expect to). I just want an efficient system in which my client gets a fair hearing before a judge who works hard, knows the law, and does not play favorites. I also expect judges to appoint qualified amicus attorneys who zealously look after children (and who actually personally visit their minor clients in their homes). Is that asking too much?
