New Jersey Supreme Court Sides with New Jersey REALTORS®

On Monday, the New Jersey Supreme Court issued a victorious decision for all New Jersey Realtors® in the James Kennedy, II vs. Weichert Co. case, which reversed and remanded to the trial court for an order dismissing Kennedy’s complaint.
This case was considering whether the independent contractor agreement between a broker and a salesperson excludes the salesperson from the Wage Payment Law, a statute that governs compensation paid to employees but does not apply to independent contractors.
The NJ Supreme Court decided that Kennedy “…who agreed in writing to affiliate with Weichert as an independent contractor, must accordingly be treated as an independent contractor.”
The court held that the written agreement is dispositive and defines the relationship between the broker and salesperson.
This decision is the result of a multi-year, multi-pronged lobbying effort to protect independent contractor status, led by the New Jersey Realtors®, for real estate licensees. Read the NJ Supreme Court's opinion here.

Two revolutionary businessmen devise an audacious and risky plan to take on the racially oppressive establishment of the 1960s by hiring a working-class white man to pretend to be the head of their business empire while posing as a janitor and chauffeur.

Directors Approve Dues Level,
Elect 2025 Leadership & More

At its May 9 meeting, the National Association of REALTORS® Board of Directors voted to keep NAR dues at $156 per member for 2025.
In a report from NAR Treasurer Greg Hrabcak, directors learned that as of April 30, “membership is tracking favorably to plan and increasing each month.” (See “Keeping Tabs on NAR’s Membership.”)
In addition, Hrabcak reported, the association has received an unqualified opinion from its auditor, Grant Thornton, on combined financial statements, including NAR, its subsidiaries, and its affiliated institutes, societies and councils.
Professional Standards
Directors approved three recommendations from the Professional Standards Committee, an amendment to Article 4 of the Code of Ethics and new Standards of Practice 4-1 and 4-2—designed to ensure the Code provides further clarity on conflicts of interest and protects buyers, sellers, lessors and lessees. The amendments will take effect on Jan. 1, 2025, if they are approved by the NAR Delegate Body in November. Read more.
