Dear NCBA Members,

The LGBTQ Committee of the Nassau County Bar Association applauds the Supreme Court's Title VII decision in  Bostock v. Clayton County.

In a 6-3 decision, the Supreme Court affirmed that employer discrimination on the basis of an employee’s sexual orientation and/or transgender status necessarily constitutes prohibited discrimination on the basis of sex under Title VII of the Civil Rights Act of 1964. The Court rejected arguments that homosexuality and transgender status are distinct concepts from sex and held that the employers’ alleged discriminatory acts on the basis of sexuality/sexual identity would not have occurred had the victims’ sex been different.

We will continue our work on the many remaining issues of concern to the community.
