Dear ATBA Team,


Thank you for your detailed piece. We appreciate the passion behind ATBA’s position. However, It fundamentally mischaracterizes the LPTVBA’s request and the principles at stake.


LPTVBA is about respecting choices for licensees — not mandates for any individual standard. We are simply asking the FCC to recognize 3GPP 5G Broadcast (Releases 16–19) as a voluntary transmission option under Part 74 for LPTV stations. This is not a replacement strategy or a push to sunset ATSC 1.0. It is an option — one that individual licensees can evaluate and adopt (or ignore) based on what best serves their communities and business models.


LPTV was established to foster innovation and local service, often in areas where full-power stations could not or would not operate. We believe it is important to preserve flexibility for these stations.


We support broadcasters who want to deploy ATSC 3.0 — many of our members have done exactly that, including stations successfully using it on Channel 6 and in “Franken-FM” applications. I personally spent 17 months and significant personal funds helping deploy ATSC 3.0 solutions for LPTV. ATSC 3.0 just could not work as marketed for our purposes. Highly respected broadcaster Weigel Broadcasting recently told the FCC that “ATSC 3.0 Corrupts Free and Simple TV Service” (https://rbr.com/weigel-to-fcc-atsc-3-0-corrupts-free-and-simple-tv-service/). LPTVBA supports ATSC 3.0 as a standard and will shortly announce a way for its members to deploy ATSC 3.0 at a much lower cost. We hope ATBA can extend that same respect to licensees who see value in having 5G Broadcast as an additional tool.


On control and spectrum risk: For the last 3 years, I have been discussing the reality of convergence, both technical and regulatory. Cellular interests are engaging on coexistence, and technical work is advancing. We believe the best path forward is a flexible approach that benefits everyone.


We recognize that full-power stations and large broadcasters have significant influence, but we believe LPTV operators deserve the autonomy to choose technical solutions that best serve their communities, without undue restrictions.


XGN Global and X1 Mobile are private companies. I am proud to serve as their CEO. Our model is straightforward: no annual licensing fees and pure choice for stations to generate new revenue through innovative services, from linear streams via mobile delivery, emergency alerts, first responder solutions, and datacasting. That is pro-innovation and pro-local broadcasting.


XGN/X1's vision is to bring a platform where LPTV licensees can actually make money while serving their local community. It is innovation at its best. And may we point out that ATSC 3.0 is licensed through private companies, while 5G Broadcast is a free 3GPP worldwide standard. 3GPP is not exclusive to cellular standards, but includes broadcasting, satellite, and others as well. It provides one worldwide standard.


Change can be challenging, but it is also inevitable. The LPTVBA believes LPTV licensees — independent operators serving their communities — are best positioned to decide which tools best serve their needs. We respectfully ask ATBA to support the principle of licensee choice.


We remain open to constructive dialogue that puts LPTV operators first and respects their right to choose how best to serve the public.
