A Statement from Attorney Jessica M. Hernandez Regarding the 87th Avenue Bridge

On December 23, 2022, the court heard argument upon Plaintiffs' Emergency Motion for Special Set Hearing. Plaintiffs requested that the court schedule their Motion for a Temporary Injunction on an expedited basis. Plaintiffs noted that on December 16, 2022, Florida Power & Light was observed at the Cutler Drain Canal C-100 relocating an electric pole, thus suggesting that Miami-Dade County is already undertaking site preparation for the bridge project.
 
During Friday's hearing, Miami-Dade County confirmed that work relative to the bridge project was performed on or around December 16. The county stated that because permitting is ongoing, a contract has not yet been awarded. The court subsequently agreed to schedule Plaintiffs' Motion for a Temporary Injunction on an expedited basis. The court will hear argument upon the motion on February 6, 2023, from 1:15 pm to 2:15 pm.
 
Notably, at the conclusion of Friday’s hearing, the court requested that Miami-Dade County refrain from taking further action until the court rules upon Plaintiffs' Motion for a Temporary Injunction. If Plaintiffs' Motion for a Temporary Injunction is granted, it will have the effect of halting any and all construction until the conclusion of litigation.
