To Boaters in Dana Point Marina,
My firm represents the Class Action Plaintiffs in the pending action in Superior Court against the Dana Point Harbor Partners regarding the massive slip fee increase imposed in October, 2021. The Partners filed an Answer, and we are presently engaged in Discovery, such as the production of documents, depositions, etc.
I am aware that some boaters have become frustrated at the delay in getting a resolution. Most of that delay is in the nature of a complex Class Action litigation; some is a result of the Partners’ delaying tactics.
However, in time we will get past this discovery stage and will be able to proceed with motions and mandatory settlement conferences and proceedings that we hope will force this matter to a positive conclusion without trial. Our goal is, if possible, to get the Partners to roll back the increase until they obtain an acceptable survey as to reasonable slip fees, and, ultimately, obtain a refund of the excessive amount of fees charged to date.
I urge boaters’ patience. While there are never guarantees, I believe we have the better argument and the stronger case in the end.
Support from the Dana Point Boaters Association and George Hughes and Wayne Addison of SOS has been invaluable for this legal battle. I hope you will continue your support for those organizations and stick together to bring this to a reasonably expeditious conclusion.
