President's Message

Fall is back in Oregon, so I hope everyone had time to get outside and enjoy the summer.


I wanted to thank everyone who came out to our events over the summer. They were very successful, and it is clear that you all are ready for an opportunity to network and connect with your fellow colleagues again.  We will work on providing even more networking opportunities next year: both educational and just for fun. It is time to start having fun again! I would also like to thank our wonderful sponsors Markowitz Herbold, Holland & Knight and Barran Liebman for helping us wade back into live events. They provided engaging activities with good food and drink, which we always appreciate. We could not do this without them! Please check out the recaps below for some great photos—you might just see yourself in one!


As we enter the last quarter of the year, we are planning CLEs with Markowitz Herbold, Perkins Coie and Tonkon Torp as well as another professional development seminar with Boly:Welch. And, we are once again partnering with Holland & Knight for the 2022 Oregon Lawyers Against Hunger Campaign. We look forward to helping make that a successful event. 


We also hope to see you in Las Vegas for ACC’s first in person conference since 2019! We will be hosting a small informal gathering on Sunday, October 23rd for all chapter members attending the conference—more details next month.


And to end the year on a high note, please be sure to circle December 8 on your calendars for ACC Oregon’s Annual Meeting sponsored by Ogletree Deakins. We are holding it on the lovely covered and heated patio at the iconic Produce Row! It’s been a long three years since we celebrated our annual meeting in person, and we cannot wait to see you all!

I recently had the opportunity to serve as lead counsel for the plaintiff in what was—as far as I know—the largest trade secrets case to ever go to trial in Oregon. Since it’s rare for a major trade secrets case to go all the way through trial these days, I want to share five lessons that I picked up along the way:

  1. The most important “element” of the trade secrets claim is the human story;
  2. Don’t fall too in love with the legal arguments supporting your defenses;
  3. Bring in—and budget for—trial consultants early in the case;
  4. With careful planning, you can protect your trade secrets from exposure at trial; and
  5. Trade secret law is sometimes the most practical way to protect your intellectual property.

In less than five months, contribution requirements under Paid Leave Oregon—initially referred to as the Paid Family and Medical Leave Insurance (“PFMLI”) program—begin. In general, Paid Leave Oregon will provide eligible individuals up to 12 weeks (or, in case of pregnancy, up to 14 weeks) of paid time off for certain qualifying purposes. While eligible individuals will not be able to apply to receive benefits under the program until September of next year, beginning on January 1, 2023, most Oregon employers with 25 or more employees are expected to begin making contributions to the PFMLI Fund.

CELEBRATING 40

YEARS OF ACC WITH

MARKOWITZ HERBOLD!

On June 30, longtime chapter sponsor Markowitz Herbold helped ACC Oregon members celebrate 40 years of the Association of Corporate Counsel. 


It was a gorgeous day for our chapter's first in person event in 2 1/2 years, and the location on the firm's expansive deck overlooking downtown was spectacular!


During the party, Markowitz Herbold sharehold Chad Colton and ACC Oregon President Emily Warren drew the winning names for the raffle. Elizabeth Semler of Bob’s Red Mill won a bottle of wine of her choice from the firm's famed wine cellar. Kat Kogan of Lam Research and Melissa Robertson of Columbua Sportswear each won gift certificates to Music Millennium so they could pick out some of their favorite music from the past 40 years. 


Thank you so much to Chad Colton, Karie Trujillo and all of the great people at Markowitz Herbold for providing this terrific opportunity for ACC Oregon members to reconnect with one another again and celebrate our organization!  We look forward to the return of the very popular ACC Oregon Family Day with the Portland Thorns later this month and a litigation CLE and social with firm in October!

HOLLAND & KNIGHT HOST SUPREME COURT REVIEW


Holland & Knight hosted a review of recent and upcoming U.S. Supreme Court cases on July 20 followed by a reception at their offices in downtown Portland. 


Attorneys Shannon Armstrong and Sarah Molinoff from Holland & Knight presented an interactive presentation in person and online about the most important Supreme Court cases from October Term 2021 for business lawyers as well as a looked ahead to October Term 2022. It included an overview of the issues presented these cases and explored what they mean for in-house counsel. 


All CLE participants also had the opportunity to win gift cards for correctly answering questions posed by Shannon and Sarah throughout the program. The winners included Brian Weeks, Kelly Kozich, Tom Horgan, Ester Smith, Tamara Kessler, Matthew Barkley, Chantal Rappi, Katherine Cowan, Debra Florence and Amanda Gratchner.


Thank you to Holland & Knight for providing this great event both online and in person!  We look forward to partnering with the firm once again on the Oregon Lawyers Against Hunger (OLAH) Campaign later this fall and their campaign kickoff event scheduled for October 20.

Barran Liebman hosted ACC Oregon at Top Golf out in Hillsboro on a sunny (and very warm) afternoon on August 18.


In addition to some great food and drinks, the firm also fostered some friendly competition with a special golf skills contest inspired by the recent “Top Gun: Maverick” film. The afternoon’s winners of trophies and an Amazon gift card were:
