ACC St. Louis Chapter President,
Beverly Garner,
Associate General Counsel, Bunge
|
Welcome to August! August means the return to school and learning for many in our communities and families, the approaching end of summer, and the push to meet this year’s goals and projects. For me, August indicates we are in the second half of my year as president of the Chapter, and the Board starts the planning process for 2025.
2024 has been full of wonderful programs, learning opportunities, and shared experiences. This year, I have focused on resources offered by ACC (including many online resources such as the 2024 ACC Chief Legal Officer Survey, ways to increase membership (including inviting prospective members to select ACC events), the benefits of volunteering and being engaged in the Chapter (such as signing up for a committee), the value of the CLEs offered by the Chapter, tapping into members for ideas for new programs and enhancements of existing programs, and connecting with sponsors through liaisons and other means. These initiatives have served as a foundation for the Board’s decisions throughout 2024 to ensure our actions are consistent with our strategies.
The Board and committee members have phenomenal programs planned for the remainder of the year. Many of the program are posted on the Chapter’s website before you receive the registration emails. Thus, I encourage you to bookmark the Chapter’s event page. When you see new events posted, save the date on your calendar. You really won’t want to miss some of these events!

Diversity Committee Event
at St. Louis Kaplan Feldman Holocaust Museum
|
(Above and below): ACC St. Louis members attend the June 20th Diversity Event
at the St. Louis Kaplan Feldman Holocaust Museum.
| |
The 27 ACC St. Louis members who attended the Impact Lab Group Tour at the St. Louis Kaplan Feldman Holocaust Museum, hosted by the Diversity Committee, were able to experience a separate engagement from the permanent Holocaust Exhibition. The conversation-based experience included discussion topics such as bias, stereotyping, hate crimes and genocide, in a space to explore how hatred presents itself in our world and the importance of going from a bystander to an active ally.
"Our visit to the Impact Lab at the Kaplan Feldman Holocaust Museum was a profound reminder of how discrimination can escalate to genocide when left unchallenged," said ACC St. Louis member, David Hartung. "The interactive session highlighted our responsibility as corporate counsel to foster equitable workplaces and intervene decisively against any form of prejudice. The lab's three-phase approach effectively illustrated the progression from discrimination to genocide, challenged us with real-world scenarios, and emphasized the human cost through survivors' stories. It reinforced that hate thrives on inaction, and as legal professionals, we play a crucial role in shaping corporate policies and culture. This experience, engaging for all ages, underscored our power to contribute to a more just society by ensuring our corporate environments are places where no instance of racism or prejudice goes unchallenged."

Organizations Face Uncertainty
After Landmark SCOTUS Agency Decisions
| |
By James R. Layton and Mollie G. Mohan
Conservative politicians and commentators have long sought to reign in the “administrative state”—the system of centralized administrative decision-making that began in the New Deal and has continued to expand over the decades. Courts have resisted that effort—recognizing, perhaps, that reducing the scope of administrative agency authority would lead to more disputes decided by judges, increased burdens on the courts, and a likelihood of inconsistent decisions among courts.
In three high-profile decisions issued at the end of the U.S. Supreme Court’s October 2023 term, the Court significantly limited the role of the regulatory state and substantially enlarged the role of courts. The three decisions restrict the circumstances in which agencies and administrative law judges can resolve disputes, eliminate deference to agency interpretation of statutes, and expand the time in which agency rules can be challenged.
Below is a summary of the key decisions and what organizations need to know.

The interns were provided with an interactive discussion on June 24th about corporate litigation by Judge Booker Shaw, Partner at Thompson Coburn, and Katherine Murchison, Associate at Thompson Coburn, which included insight into some of their past cases.
