2024 Presidential Update

On January 26, I opened LinkedIn to post a photo from ACC’s Annual Dinner and Volunteer Recognition Night. My draft started, “I am honored to serve as the 33rd President of the St. Louis Chapter of the ACC.” Serving as President of this distinguished Chapter is an honor and being the 33rd President has added meaning for me. I wore the number 33 on my high school basketball uniform, and my father wore the number 33 on his. This shared uniform number has served as an unending thread stitching Dad and me together in ways beyond our shared love of the game.

 

Even though my high school basketball uniform has long been turned in, 33 has remained my special number. When it shows up, and it seems to show up often, it serves as a sign. It symbolizes strength, comfort, and goodness. When I realized I was the 33rd President of this awesome organization, I paused. I knew 2024 would be a great year.


In fact, 2024 is off to a wonderful start. More than 50 members attended the Annual Dinner and Volunteer Recognition Night at Bar Napoli. We honored Geoff Grammer and the Professional Development Committee as the Committee of the Year, Dante Tamprateep as the Member of the Year, and Michael Curoe with the 2023 William E. Jaudes Award. Congratulations to each of you, and thank you for your contributions to ACC. We also thanked Pat Duft, Pam Howlett, Brian Parsons, Chris Wittenauer, and Denise Whitener, who are departing the Board, for their excellent service to the Board. Finally, we send a big thank you to Bill Corrigan and Shook Hardy & Bacon for sponsoring the Annual Dinner and for being a new ACC sponsor in 2024.

What Employers Need to Know About Non-Competes in 2024

2023 was a tumultuous year in the non-compete world. Non-competes came under unprecedented attack from all levels of state and federal government, especially including the Federal Trade Commission. The constantly evolving state of the law can leave employers confused and companies’ competitive information vulnerable.


In the new legal landscape, companies must take a more nuanced approach to using restrictive covenants to protect against unfair competition. For some workers, like highly compensated executives or those with technical expertise and training, a non-compete may still be the right answer. But for many workers, it is not. Simply put, wholesale reliance on generic non-compete clauses with large portions of your workforce is a bad practice in 2024.


The recent challenges to the viability of non-competes are a reminder that a non-compete is just one tool available to employers to protect against unfair and unlawful conduct by a departing employee. This article outlines what employers are up against in using and enforcing non-competes in 2024 and recommends some strategies to consider in lieu of non-competes.


The Proposed FTC Rule Banning Non-Competes

Just days into 2023, the Federal Trade Commission proposed a rule banning employers from using non-competes with their workers.[i] Specifically, the Proposed Rule Forbids employers from (1) entering in to, or attempting to enter in to, a non-compete clause with a worker; (2) maintaining a non-compete clause with a worker; or (3) representing to a worker that the worker is subject to a non-compete clause unless there is a good faith basis for believing the non-compete is enforceable. The FTC defines “employer” and “worker” broadly to capture essentially any work force relationship, paid and unpaid, including everything from employees to independent contractors to volunteers.

Pro-Bono Wrap 'N Pack Event

The ACC Saint Louis Pro-Bono Committee is offering members an opportunity to combine networking with volunteering through a Wrap 'N Pack event at Operation Food Search (OFS) benefitting children in need through the Operation Backpack child nutrition program. Since it's start in 2006, this program has provided weekly sacks of kid-friendly, shelf-stable food to get students through the weekend when school meals are not available to them. Filled backpacks are discreetly given to participating children to take home, enabling them to come back to school on Monday with good nutrition and the focus needed to achieve academic success.


The Wrap 'N Pack event begins at 5:00 pm with member networking amidst drinks and appetizers, after which the group will assist OFS staff in the organization of 100 bags of food for Operation Backpack. Once this activity is completed, attendees will return to socializing activities at happy hour.


"I recommended OFS because I attended some events there and thought this would be a fun way to perform pro bono service, but also socialize with fellow members," explained Pro-Bono Committee member, Cierra Heitholt.


The OFS program distributes approximately 6,500 backpacks each week across 15 counties in both Missouri and Illinois. Volunteers need only bring themselves to the event, as all necessary packing materials are provided on site.


"Operation Food Search has been providing food, nutrition education and programming to reduce food insecurity for over forty years in Missouri and Illinois," said Pro-Bono Committee Chair, Essica Zink. "ACC Saint Louis is proud to have the opportunity to partner with this long standing pillar within the community."
