|
Spring has sprung in St. Louis, and the St. Louis ACC 2024 Program year is off to a strong start.
In April, the ACC global organization once again selected the St. Louis Chapter as a winner of the 2023 Chapter of Distinction Award. I want to congratulate the Board of Directors, committee members, and members for creating community among in-house counsel, hosting outstanding programs, and engaging members, sponsors, and partners throughout the region. Way to go!
Speaking of partners, the Professional Development Committee partnered with Washington University Olin School of Business to present a program on April 12 on Influencing Positive Corporate Culture. Dr. Ashley Hardin shared insights on informal leadership including navigating politics, understanding power, and exercising influence. Prof. Elanor Williams continued the conversation by teaching attendees to apply behavioral science to how they structure and present everyday decisions to assist others to make better choices as consumers, employees and citizens. More than 90 members and legal interns for member companies attended this popular, award-winning event. Attendees received 3.0 hours of CLE.

ACC Saint Louis would like to congratulate two of our active members, ACC Saint Louis President, Beverly Garner with Bunge, and Hannah Nelson, with BJC Health System, for each being selected to receive a 2024 Women's Justice Award in the Corporate category. These awards recognize women in 11 segments of the legal community across Missouri who have demonstrated leadership, integrity, service, sacrifice and accomplishment in improving the quality of justice and exemplifying the highest ideals of the legal profession. Both Garner and Nelson will be presented their awards on Awarded on May 16th at Ameristar Casino & Resort.
"I am thankful to have spent the majority of my legal career at Bunge where I have had the opportunity to sharpen my legal skills and continue my professional development," says Garner. "Bunge also supports my interests in serving the community such as my work on the Ronald McDonald House Board and the Association of Corporate Counsel Board. Being selected for this award is not only a reflection of my work but also the Bunge legal team which has allowed me to grow and serve.
Nelson believes that it's amazing to be honored and selected alongside so many other amazing women lawyers. "It is really humbling. I’m really grateful to practice health law at BJC, and am grateful to be recognized for my work at an organization that has such a strong impact on our patients and community."
Both Garner and Nelson decided to pursue the legal field through differing personal routes.

Generative AI and Fair Use: Lessons from Pop Artists
By: David Kim, Stinson, LLP
Artificial intelligence (AI) systems analyze data from various sources to recognize patterns and make predictions. But when the data used to build and train these AI systems includes copyrighted materials – and the output generated by these AI systems resembles creative expression – it raises complex questions regarding copyright and fair use. On the one hand, copyright is essential for protecting artists' rights and incentivizing creativity. On the other hand, copyright can stifle creativity and inhibit the free exchange of ideas.
Artists have long used appropriation – the borrowing, copying or incorporation of pre-existing works – to build upon the artistic expression of others. The strategy started to take on new significance at the start of the 20th century. Popularized by Cubists, Dadaists and later Surrealists, appropriation eventually became synonymous with pop artists like Andy Warhol.
Reproducing, juxtaposing and repeating everyday images is how Warhol and other artists commented on the pop culture of their day. In the 1960s, Warhol famously painted 32 cans of Campbell's soup – "I used to have the same lunch every day, for twenty years, I guess, the same thing over and over again" – and managed to avoid legal trouble over his unauthorized use of the Campbell's logo due to the free marketing the company received. Warhol died in 1987, but his estate continues to face legal challenges over his silkscreen prints, which feature instantly recognizable products and people.

Maintaining mental health in the workplace has garnered critical attention in recent years, so the American Bar Association continues with its eighth annual Well-Being Pledge Campaign to improve the substance use and mental health landscape of the legal profession. In connection with this campaign, Well-Being Week in Law - an initiative of the Institute for Well-Being in Law - occurs in the first week of May to raise mental health awareness and encourage action throughout the legal profession.
The 2024 theme of Well-Being Reboot focuses on a fresh start for positive change, and recommends activities and webinars for each day of the week: Monday - Stay Strong / Tuesday - Align / Wednesday - Engage & Grow / Thursday - Connect / Friday - Feel Well, which can be found HERE. Everyone who registers is entered into a raffle for free well-being related prizes.

Personally Benefit by Helping to Expand Chapter Membership!
This year, our Chapter is focusing on increasing the number of new members while working to engage with our existing members.
"We know that most people reading this newsletter are already ACC members, but we also know that many of you know in-house counsels who are not ACC members and may be interested in joining," says Cara Stuckel, ACC Saint Louis Chapter Membership Chair.
ACC Saint Louis President, Beverly Garner, explains that "The Chapter's strategic plan is intended to provide a solid foundation for the organization into the future. The organization depends on engaged membership. Thus, we strive to increase membership and member engagement."
In furtherance of our efforts to increase the number of chapter members, we challenge you to identify any three in-house counsel who are not current members of ACC and encourage them to join. Our chapter is running a little competition in order to help incentivize this journey! Each member who emails the names and email addresses of three or more prospective ACC members to accstl@qabs.com and includes a quote about the value you have personally received as a member, will be entered for a chance to win a $150 Visa gift card. The winner will be selected on June 3, 2024.
