President's Message:
Missed Opportunities
|
By: 2023 ACC St. Louis Chapter President, Jenny Herner, Associate General Counsel,
Anheuser-Busch
|
In 1883, 5-year-old Hattie May Wiatt arrived at church only to find the room for children’s classes too crowded to get in. When the pastor found her standing outside, he told her they would one day have a building big enough for everyone.
Hattie May died in 1884 and, at the funeral, her mother gave the pastor a bag containing 57 cents and the note ‘To help build the little [classroom] bigger….’ The pastor told her story, sold each of the 57 pennies for a donation, and, after the press picked up the story, raised enough money to buy a new building. That building would later house the first classes for what is now Temple University. Hattie May made a difference.
Many of us went to law school with the hope that we would one day make a difference, but, when in the thick of document reviews or contract drafting or research, it sometimes is hard for us to see how we are.

Proposed FTC Ban on Noncompetes:
Considerations for Companies to Protect Trade Secrets
By: John Schroeder, Stinson LLP
| |
In January 2023, the Federal Trade Commission (FTC) unveiled a proposed ban on noncompete clauses that prohibits employees from joining or forming a competitive business entity following the termination of their employment. According to FTC Chair Lina M. Khan, “Noncompetes block workers from freely switching jobs, depriving them of higher wages and better working conditions, and depriving businesses of a talent pool that they need to build and expand. By ending this practice, the FTC’s proposed rule would promote greater dynamism, innovation, and healthy competition.”
While this criticism may ring true in the case of lower-wage workers, such as restaurant and warehouse employees, even the staunchest critics of noncompete clauses will typically acknowledge that they can – and often do – play a legitimate role in the protection of trade secrets. This is why the FTC’s proposed rulemaking is causing consternation in the intellectual property community.

the 2023 Corporate Counsel Institute (CCI)
|
On May 9, 2023, the Saint Louis Chapter of the Association of Corporate Counsel (ACC), in partnership with the Bar Association of Missouri St. Louis (BAMSL), hosted members from across the legal community for their 42nd Corporate Counsel Institute (CCI). This year the event was held at the historic Chase Park Plaza Hotel in Saint Louis’ Central West End.
Over two hundred attendees gathered for the CCI, bringing together in-house counsel and their colleagues in private practice, as well as a host of professionals in the legal services industry for a day of learning and networking. The event offered a full day of Continuing Legal Education (CLE) sessions and networking opportunities throughout the day. Sponsoring firms delivered informative presentations on a wide range of topics, including recent policy changes by the National Labor Relations Board (NLRB), employee privacy laws, legal ethics, and the practice of law in a corporate environment.
