National Pro Bono Month

October is National Pro Bono Month. This annual opportunity is a way to shine a national light on the pro bono work provided by thousands of lawyers, paralegals, and law students. 
 
Each year, Association of Corporate Counsel St. Louis members give hundreds of hours of free legal counsel and guidance, and volunteer for community services projects through programs and events arranged by the Pro Bono Committee. Patricia Duft is the 2022 ACC STL Pro Bono Chairperson, and Senior Legal Director, Medtronic.

“Each October, we are reminded of the impact that we can make as attorneys in our community. ACC STL members consistently step up and show up to provide much needed free legal counsel to underserved communities, families and individual. By giving back to the St. Louis legal community, we gain much more personally than we professionally give to the clients we serve by preserving access to legal services. This is the foundation of our legal framework,” said Duft.

Patent Ownership
When Your Research and Development Staff Depart

As a patent practitioner, I spend a lot of time securing assignments from inventor employees on patent applications, so that their employers can apply for and own the resulting intellectual property. Many people assume that inventions of full-time employees are automatically owned by the company, but this is not always the case. In fact, practices can differ widely depending on the type of employee and the jurisdiction at issue.

This article illustrates some key differences by considering a case study and providing commentary on legal implications and practices in Canada and the United States.
 
To start, let’s say that you have hired an information technology helpdesk technician named Yuki, on an employment contract appropriate for a full-time helpdesk employee.

2022 Member Appreciation Event
The 2022 ACCSTL Member Appreciation event welcomed over 175 guests on the night of Tuesday, September 20th at Centene Stadium in downtown St. Louis. Attendees were able to mingle while touring the new facility across from Union Station.

Membership Chair, Chris Wittenauer, was happy with the venue and sponsorship results. "I think it went amazingly well. We were the first corporate event at the stadium, so it was all new for them and they did a great job! The venue was great, and we were able to take advantage of the whole building".

He noted that the event committee came up with, and with the help of Susan Wagner and Jim Andrews, planned an amazing event that he thinks will be remembered for a long time.

Beverly Garner of the event committee, noted that the new stadium provided a beautiful venue to express to ACCSTL members how much we appreciate them by enjoying a tour of the stadium and plenty of space to celebrate and catch up with colleagues.

"It is important to take time to focus on our members who plan, execute and attend various programs throughout the year," explained Garner. "It was especially nice to have the opportunity to gather after so many months of virtual events."

2022 UNION RESURGENCE

In light of arguably the most labor-friendly President in the past seventy-five years, unions have been making a huge comeback as union organizing is up fifty-six percent (56%). Notably, organizing efforts are being made in industries that have historically been left out of the traditional, union trade industries, including restaurants, sports, and retail. Some of the leading names within their respective markets have had the biggest movements in organizing – which only leads us to assume that there will be many more to follow.

For instance, in the food-and-beverage industry, Starbucks employees across the country have filed petitions and held elections in efforts to organize. As of August 2022, at least 209 Starbucks cafés have officially voted in favor of unionizing. This is extremely rapid movement, considering that in January of this year, only two Starbucks cafes had unionized.

Burgerville – a Northwest fast-food chain employing around 800 people at forty locations – recently became the first traditional “fast-food” restaurant to enter into a collective bargaining agreement. Both Starbucks and Burgerville were enormous steps for food-and-beverage workers everywhere and others have begun to take notice. Chipotle seems to be the next chain restaurant to jump on the bandwagon, as their first restaurant voted to unionize in Michigan just last month.
