ACECL’s Capitol Calculus
The 2022 Regular Legislative Session resulted in several favorable outcomes for engineering. No bills with negative impacts to the industry were enacted into law.
Over the next several months, the ACEC/L Legislative Committee will host several committee meetings to discuss and develop our legislative priorities for the next session. Part of this process will be determining what legislation ACEC/L will bring before the legislature and begin the drafting process.

PPP Loan and FAR Credits Clause
|

In Washington, the House has once again adopted ACEC’s PPP amendment as part of a larger package of amendments to the FY’23 National Defense Authorization Act or NDAA. Further consideration and a final vote on NDAA is expected this week.
As you may recall, the House took similar action late last year, and we’re pleased to see the continuing and bipartisan support this issue is receiving in the House. We still have work to do to in the Senate as you know, but this action by the House definitely only helps.
As we turn our advocacy efforts to back to the Senate, ACEC/L is reaching out to our Senator Kennedy and Senator Cassidy asking them to co-sponsor similar stand-alone legislation (S. 3711) pending in the Senate sponsored by Senators Mike Braun (R-IN) and Tammy Duckworth (D-IL).

While we are still advocating for a fix to the issue in Washington, the fact remains that state DOT's and their compliance departments are required to enforce the FAR Credits Clause as it relates to PPP loan forgiveness.
Seeking information for our members on how LaDOTD is handling audits involving PPP loans, I reached out to their Audit Director for any information/guidance he could provide. I was informed that they have hired a third-party CPA firm to handle these types of audits due to their complexity.
To assist firms who are undergoing or will undergo audits involving PPP loans and the FAR Credits Clause, LaDOTD provided the Q&A document below.

The 2022 Deep South Convention was another successful collection of ACEC members from our neighboring states. The convention welcomed 182 participants, including 111 full registrants with 41 coming from Louisiana alone.
Nine total speakers provided participants with information ranging from innovative paradigm shifts related to firm business modeling and hiring practices to pragmatic information related to the economic outlook for the engineering industry, specifically emerging markets created by IIJA.
