Fraud continues to plague Canada and costs sustained by the victim, as a result of the fraud or indirectly due to subsequent events such as the mishandling of investigations continue to mount.

We have managed to provide attendees with a session entitled "Negligent Investigations and Assessing your Lawyers Accounts".

The Association of Certified Forensic Investigators of Canada (ACFI) will address relevant topics by leading professionals in the field, sharing knowledge and industry best practices.
 
Mr. Brian Greenspan, one of the most prominent and well-regarded defense lawyers in Canada with over 40 years of experience, presents the keynote address "Fraud Investigations" which will encompass the past, the present and what the future might hold for those involved in the profession.

We are pleased to have added John Olah and Roman Myndiuk of Beard Winter as speakers. They will be addressing the recent Moore v. Getahun case which deals with the interaction between counsel and the expert. This case has tremendous ramifications to experts.

 

Readers should note that Mr. Olah had the privilege of arguing the Moore v. Getahun case for the Canadian Defence Lawyers Association.

 

We are also pleased to announce that Mr. Norm Groot will address "Negligent Investigations and Assessing your Lawyers Accounts" during day two of this year's ACFI conference. This is a remarkably good opportunity to learn from others who have perhaps performed slipshod investigations.

Corruption & Conflict of Interests
Workshop leader: Courtenay M. Thompson

Justice Charbonneau has called for Quebecers to work together to stop corruption. The ACFI endorses this call and encourages all Canadians to work towards this goal.

Responding to this need to address corruption and conflicts of interest we are pleased to announce that Mr. Courtenay Thompson of Courtenay Thompson & Associates has agreed to change his Sunday May 3rd workshop to address Corruption and Conflicts of Interest.

Although many reported cases reflect corruption in government the Canadian private sector has had its embarrassments as well.

Given recent events internal auditors and others can expect to increasingly be held accountable for detecting and investigating corrupt matters.

You'll also learn how linguistic lie detection techniques can be applied to a variety of high-profile media cases to illustrate examples of deception.

CPD Requirements  


The minimum CPD hours required to stay current as a Certified Forensic Investigator is 20 hours per annum of which 10 are required to be fraud related and relevant to the area of a member's practice or employment. For example, a law course taught in Europe would not appear to be relevant for Canadians who are attempting to keep current with the laws of Canada.
 
Therefore under the rules of the ACFI, credits deemed not to be germane to Canada will not be allowable towards the 10 fraud related credits required.
 
Most Certified Forensic Investigators are aware of the aforementioned however the reason for bringing this to your attention again was due to a statement made by Mr. Richard Tchir a prosecutor with Alberta Justice and one of our speakers at an ACFI Fraud Conference, who made the following statement:   

   

"I found the conference a very worthwhile and interesting one and that especially refreshing was the Canadian content at the sessions I attended. I have found that at many other conferences and seminars that I have attended all too often the content is full of American information that sometimes is difficult to translate into the Canadian experience, and such was not the case at the ACFI."

(They supposedly evaded their employment contracts by inviting a co-conspirator to fire them, expecting he'd then be fired, too.) But in Canada, in 2015, Don Draper would be successfully sued for "breach of fiduciary duty."
