Recent Case Law Summaries & Legal Developments
Canada
 
In Chandos Construction Ltd. v Deloitte Restructuring Inc. (2020 SCC 25), the Supreme Court of Canada ("SSC") confirmed the existence of the common law anti-deprivation rule. This rule is an important common law contract principle, particularly as a mechanism for protecting creditors' interests in insolvency or bankruptcy proceedings. United Kingdom
 
On June 25, 2020 the Corporate Insolvency and Governance Act (the "Act") received Royal Assent and is now in force. This landscape changing legal framework has both permanent and temporary reforms. Click here to explore this Act which is the most extensive change in the insolvency landscape since the Enterprise Act came into force in 2003.
 
Additionally, in 2020 the UK government adopted new measures that are believed to be of material relevance to financial restructurings and corporate reorganizations.
