The Alternative Dispute Resolution Section of The Florida Bar is comprised of a superb group of dedicated and talented individuals. The wonderful thing about our Section is that all of these fine people are dedicated to bringing peace to our world in their own way through collaboration, enhanced communication, and creative problem-solving.

Since dispute resolution touches nearly every facet of the law, I firmly believe that The Florida Bar as a whole is elevated through the combined experience, skill, and contributions of the members of the Alternative Dispute Resolution Section.
My goal this year, COVID notwithstanding, is to build a greater connection with all sections of The Florida Bar, the Florida Dispute Resolution Center, and you, the members of this great Section. Through these combined efforts, we may have the best chance to realize real impact and change as to how we resolve disputes and ultimately interact with each other. This first starts with you, the member.
There are different reasons why you have joined our Section. We want to hear from each of you as to why you have joined the Section and what you would like to see this Section do. There are enormous opportunities to make a difference and impact the future policies and procedures for dispute resolution in Florida. For that, we encourage everyone to become active and intimately involved in the Section's work. There are exciting changes on the horizon and wonderful opportunities to truly lead through our Committees and project work.
Don't be shy. Be heard. Lead. Make a difference. Bring peace.

Mediators Encouraged to Get Training to be Qualified Under New State Statute
|
|
|
Florida is the first state in the nation to statutorily recognize eldercaring coordination, a court-ordered dispute resolution process for aging persons and their families that promotes respect for the voices, autonomy and safety of older adults.
|
|
|
Sen. Dennis Baxley (R-Ocala) and Rep. Brett Hage (R-The Villages) sponsored the legislation, which won the unanimous approval of all committees and subcommittees of reference and on the floors of both houses during the 2021 Legislative Session. Gov. Ron DeSantis signed CS/CS/HB 441 on June 4 and Section 44.407, Florida Statutes, became law on July 1.
Eldercaring coordination can protect older adults and help families avoid the costs, time and heartache involved in court battles over the care and safety of older adults. A trained eldercaring coordinator may be appointed by the court for up to two years to assist with transitions that families experience in caring for their aging loved ones. Eldercaring coordination can help to resolve non-legal issues more quickly, with less conflict and in a private forum rather than in court.

This training meets the ACR/FLAFCC Guidelines for Eldercaring Coordination and 28 hours of eldercaring coordinator training specified in the Florida Statute (s. 44.407, F.S.). The training program emphasizes experiential learning using demonstrations, simulations, practice, and roleplays, with debrief and feedback to reinforce the application of skills. Interactive experiences will make ethics and the aging process come alive as it pertains to eldercaring coordination.

How do litigators and other attorneys improve client relationships and maintain profitability during the pandemic?

Surveys reveal that institutional purchasers of litigation services do not use trial results as the barometer for selecting law firms. Most in-house counsel or litigation managers cite counsel’s responsiveness, the timeliness of reporting, and the efficiency of resolution as their key factors for choosing law firms.
Against this backdrop, it makes little sense for law firms to market legal services by stressing only their trial skills, which are rarely used, and which are not the articulated benchmark for clients. Efficient resolution through early mediation or other means is now and will continue to be, the way lawyers and law firms are comparatively evaluated.
Learn what is required of law firms to retain clients and increase profitability in a resolution-based culture. December 3: MEAC Year in Review

This presentation will analyze some of the newest MEAC opinions, explain why MEAC reached the conclusions it did for each question it was presented, and consider the potential implications of each MEAC opinion. Throughout the presentation, program attendees will be asked for their thoughts, concerns, and interpretations of each MEAC opinion.

The ABA Dispute Resolution Section's Mediation Week 2021 is the third week of October and The Florida Bar ADR Section will be highlighting section members and their thoughtful reflections on what mediation means to them. Training the Next Generation of ADR Practitioners

ADR Section Treasurer Christy Foley is a visiting lecturer at UCF, teaching mediation and coaching the undergraduate Mediation Team.
Christy said, "The students are so engaged in learning about the mediation process and how to effectively resolve conflict that our classroom discussions constantly inspire me to improve my own mediation skills as well as question why I take certain actions during my mediations.
