Kinship Foster Care Standards
This month, the Administration for Children and Families finalized a rule that allows states to set standards for kinship foster homes that are specific to kin. Our friends at TACFS explain the significance of this new rule for children and youth needing out-of-home care. For Title IV-E funding, each state’s foster care licensing agency is now permitted to develop specific kinship foster home standards.

New State Requirements
  • As of October 3, 2023, a new community behavioral health services provider applying for initial certification of services must hold national accreditation for the services that OhioMHAS determines have national accreditation standards.
  • Organizations that have applied for initial certification of services prior to October 3, 2023 and currently certified community behavioral health providers must have national accreditation when seeking renewal certification on or after October 1, 2025.
Oregon SUD providers were required to submit ASAM applications this month and will need to begin providing programs in alignment with ASAM Levels of Care (LOC) criteria by April 1, 2024. Licensing and Certification compliance reviews and investigations will use the new ASAM rules for all programs starting April 1, 2024.

AG’s knowledge and expertise in national accreditation and in ASAM LOC criteria can support Ohio and Oregon providers’ compliance with these new licensing/certification requirements.
Telemedicine Temporary Rule Extended by DEA
The DEA has re-extended COVID-19 Telemedicine Flexibilities for Prescriptions of Controlled Medications through December 31, 2024. This extension allows prescribing of controlled medications via telemedicine even when the prescriber has not conducted an in-person evaluation.
