Opioid ‘Negotiation Class Action’ Under Consideration in Cleveland Court Should Be Rejected
Opinion by George Jepsen, former Attorney General of Connecticut, and
Perry Zinn Rowthorn, former Chief Deputy Attorney General of Connecticut
Cleveland.com
July 15, 2019
A novel “negotiation class action” is being hyped as the key to unlocking legal settlements between cities and counties and opioid companies accused of marketing misconduct. In reality, it is a trap for unwary local governments, tying their hands and ceding their authority to private class action trial lawyers. The proposal, which is currently under consideration in federal court in Cleveland, should be rejected outright or fundamentally revised.

New Mexico Attorney General Balderas Urges FDA to Partner with States to Protect New Mexican Consumers of Cannabis-Derived Products
July 17, 2019
Attorney General Hector Balderas joined a coalition of 37 bipartisan State Attorneys General urging federal cooperation with the states to protect consumers from false advertising and harms to their health from products containing cannabis or cannabis-derived compounds, including cannabidiol (CBD). In a public comment filed with the Food and Drug Administration (FDA), the AGs highlight the need for research into the risks and potential benefits of cannabinoid products to inform consumers and assist in state-level regulation. They also encourage the FDA to continue partnering with state consumer protection authorities as it considers guidelines for this emerging market.
The multistate coalition includes the states and territories of Alabama, Alaska, California,
Connecticut, Delaware, the District of Columbia, Guam, Hawaii, Illinois, Iowa, Kentucky,
Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Montana,
Nebraska, Nevada, New Jersey, New York, North Carolina, North Dakota, Northern Mariana Islands, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, Tennessee, Vermont, Virginia, and Washington.
