AHCA NCAL 2023 Commitment to
Quality Award
The American Health Care Association and National Center for Assisted Living (AHCA NCAL) recently announced the recipients of the 2023 Bronze – Commitment to Quality Award. Nationwide, 277 skilled nursing care centers, 57 assisted living communities, and 60 facilities that offer both skilled nursing and assisted living from 47 states achieved the Bronze Award, the first of three distinctions possible through the AHCA NCAL National Quality Award Program.
Congratulations to Amy Malkin and Team from Arroyo Gardens in Green Valley, Arizona for being awarded the Bronze level in the AHCA NCAL National Quality Award Program this year! Amy, an AHCA NCAL and AHCA graduate of the leaders’ programs, along with AHCA Board member has been a major advocate for quality over the years. She and her team will be celebrated at the national AHCA NCAL Convention and Expo in October in Denver, Colorado.

AHCA NCAL Congressional Briefing | |
Last week was a busy week joining members in Washington DC at the AHCA NCAL Congressional Briefing to discuss the challenges impacting long term care. More than 500 long term and post-acute care professionals gathered on Capitol Hill for this weeklong event.
Along with presenting issues in long term and post-acute care to legislators, we heard from House Minority Leader Hakeem Jeffries and U.S. Rep. Cathy McMorris Rodgers of Washington. AHCA NCAL President and CEO Mark Parkinson said, "It is crucial that we share our story with members of Congress, so it is amazing to see so many of our members here in D.C. this week to do exactly that." Moreover, AHCA Chair Phil Fogg said, "We must share the meaningful and vital work we do in providing quality care to millions of Americans, the hurdles in place that make caring for our residents more difficult, and the need for policymakers to invest in our seniors and their caregivers."
While on the Hill, the attendees touted a survey from AHCA NCAL of 400 nursing home providers that showed that one third of nursing homes say that their workforce situations have worsened since the beginning of the year and 77% of facilities face moderate to high staffing shortages. In other words, this is no time for staffing ratios.

RIP PRF
The bipartisan debt ceiling deal has officially signaled the death knell for the Provider Relief Fund, with billions in funds that potentially could have assisted senior living and other long-term care providers unspent.
The Health Resources & Services Administration last Monday released a program update indicating that with the passage of the Fiscal Responsibility Act of 2023, no further payments will be made to aging services providers under the PRF or the American Rescue Plan Rural Distribution.
This stoppage includes providers seeking redeterminations of PRF awards. Any funds providers pay back through the PRF also will be kept.

MDS Changes to
Section B
Since their release on April 3, 2023, MDS 3.0 version v1.8.11v2 final item sets and draft RAI guidance were updated and substantial changes were made to several sections. Changes to section B include:
- Incorporation of the Standardized Patient Assessment Data Elements (SPADES).
- Health Literacy, which allows for standardized data collection across all health care settings.
AHCA NCAL has created an MDS Section B resource document to help providers understand the changes. The information in the resource document outlines key changes to MDS Section B, Coding Instructions/RAI Guidelines for each item, and Actions to Consider for implementation across a facility.
It is important that facilities develop a training plan to ensure all staff impacted by the changes are well versed in them.

SCOTUS Rules Against Nursing Homes
Nursing homes could see an explosion of lawsuits following last Thursday’s US Supreme Court ruling that maintains the right of nursing home residents and their survivors to sue in federal court over key care provisions.
Health and Hospital Corp. v. Talevski revolved around the Federal Nursing Home Reform Act of 1987 and whether the oversight and regulatory elements of the Medicaid system preempted individuals from bringing private court actions to seek redress for violations of their rights in nursing homes.
The 7-2 ruling, experts said, more broadly protects the right of any individual to sue for civil rights violations, even when federally funded programs being run by states have existing mechanisms to address such concerns.
The Court’s majority upheld a lower ruling against the Health and Hospital Corporation of Marion County, a public entity that operates nearly 80 nursing homes in Indiana. HHC had argued that the state Medicaid system’s existing oversight pathways were the right avenue for aggrieved parties to seek recourse.
The ruling could have far-reaching implications for people beyond just those living in nursing homes, including those who rely on all kinds of federal benefits managed by government partners.

CMS Requirements for Hospital Discharges to SNF | |
CMS provided guidance to hospitals on the importance of providing SNFs and other post-acute providers with appropriate patient information related to a patient’s treatment and condition in order to decrease the risk of readmission or an adverse event.
CMS has identified areas of concern related to missing or inaccurate patient information when a patient is discharged from a hospital. These areas of concerns include missing or inaccurate information related to:
- Patients with serious mental illness, complex behavioral needs, and/or substance use disorder. Information related to patient’s acute condition may be included, but information related to the patient’s underlying diagnoses of SMI and/or SUD is not included. Specific treatments that were implemented to help manage these conditions while in the hospital are omitted from patient information upon hospital discharge.
- Medications, such as an incomplete comprehensive list of all medications that have been prescribed to a patient during, and prior to, their hospital stay.
- Patient’s skin condition on discharge and orders for treatment if indicated.
- Durable Medical Equipment, used for respiratory treatments such as Trilogy, CPAP/BiPap or high-flow and skin healing equipment for example mattresses, and wound vacuum machines.
If the above information is not provided, SNF providers may not be equipped or trained to care for certain conditions the patient may have. Not only can this place the patient’s health at risk it can also put the health and safety of other residents in a SNF, as well as provider staff, at risk.

Infection Control Pathway Updated to Reflect End of Staff Vaccine Requirement
Last week, CMS updated the Infection Control Critical Element pathway related to the end of the Healthcare Provider Vaccine Mandate announced May 31, 2023. The pathway was updated to remove all surveyor guidance related to F888 (Staff Vaccine).
Surveyors are advised to verify compliance with requirements for educating and offering COVID-19 immunization only. All other areas regarding staff COVID vaccines were removed from the pathway. The Entrance Conference form was also updated to remove all staff vaccine requirements. The Entrance Conference form removed the need for facilities to maintain a vaccine matrix. Facilities are reminded to continue to document vaccine education to both residents and staff.
There is also a change unrelated to the vaccine update. Under "Instructions" for the Interim LTCSP Initial Survey and Certification Process, facilities that are not yet certified should still complete minimum data set (MDS) assessments, despite not being able to submit them until the facility is certified.
The Final Rule was added to the Federal Register, as expected. The rule becomes effective on August 4, 2023. Please contact AHCA’s Kay Huff with further questions.

AHCCCS Leadership Changes | |
AHCCCS recently filled five leadership positions rounding out the agency’s executive management team and completing the new structure that combines the Division of Fee for Service Management (DFSM), the Division of Community Advocacy and Intergovernmental Relations (DCAIR), Communications, and Legislative Affairs under a new Deputy Director of Community Engagement and Regulatory Affairs. Those changes include the following personnel:
- Marcus Johnson, Deputy Director of Community Engagement and Regulatory Affairs
- Alex Demyan, Assistant Director of the Division of Community Advocacy and Intergovernmental Relations (DCAIR)
- Kyle Sawyer, Assistant Director, Public Policy and Strategic Planning
- Ewaryst Jedrasik, Assistant Director, Division of Fee for Service Management (DFSM)
- Leslie Short, Deputy Assistant Director of Division of Fee for Service Management (DFSM)

Legislative Update
Both chambers remained recessed until yesterday, June 12. As they returned, they finally have all 90 seats filled. The Maricopa County Board of Supervisors named Quantá Crews to fill the vacancy left by LD26 Senator Flavio Bravo when he was appointed to the Senate from the House. She has yet to be sworn in, but that will happen soon.
Additionally, Governor Katie Hobbs has now vetoed 106 bills—nearly double the previous veto record of 58 bills set in 2005 by then-Governor Janet Napolitano. There are many rumors circulating about what the chambers will do—adjourn sine die? Stay in session until August? Stay in session until October? We’ll just have to wait and see how this plays out.

Be Prepared for Seasonal Heat-Related Emergencies
Don't wait for temperature records to be shattered or the power to fail at your facility or community this summer before preparing your team for heat-related emergencies. Now is the time to prepare for the hazards and perils associated with extreme heat emergencies.
Train your staff to understand that high temperatures not only represent the obvious threats associated with heat-related illness. Excessive heat can also cause a variety of problems including region-wide power failure and internal mechanical / equipment failure in prolonged incidents as well as staffing issues and supply chain disruption.

AHCF 2023 Silent Auction - Donation Request
Over the past several years the Arizona Health Care Foundation has awarded thousands of dollars to support residents and staff in skilled nursing facilities and assisted living centers through the Live A Dream program. This program grants the wishes of residents in your communities.
