AHCA BOARD OF DIRECTORS ELECTION | | |
New Board is Seated
Congratulations to Brett Robertson, Haven Health Group for being elected President!
Kelly Bojorquez, The Forum at Desert Harbor was elected as Vice President and Kris Woolley, Avista Senior Living was elected Secretary / Treasurer.
In addition, Jeremy Bowen, Bandera, Lisa Leveque, Bandera, Kristen Ott, Creative Care, Inc. and Nigel Santiago, Vincero Healthcare (congrats to Nigel and his wife on having a baby boy last Thursday -- 8 lbs 1 oz / 19 1/2 inches. Both mom and baby are doing great!) were newly elected to represent their respective regions.

CMS and Minimum Staffing Update |
On a National Nursing Home Stakeholder call last week, CMS officials said they received more than 3,000 comments that are now being used for its upcoming research study on minimum staffing and to develop its draft proposal in 2023. The agency also stated its plans to host stakeholder listening sessions next month to get more input ahead of its proposal.
CMS is in the midst of examining ways to set minimum staffing requirements for nursing homes as part of President Joe Biden’s nursing home reform initiatives, and called on providers to give input on the matter when it issued its proposed 2023 Skilled Nursing Facilities Prospective Payment System in mid-April. The research study will specifically assess the minimum staffing requirements needed in facilities.

AHCA NCAL Report on Staffing
AHCA NCAL released a new report last week week from CliftonLarsonAllen LLP (CLA) on the negative impact of increasing staffing minimums at the federal level. The report shows that increasing staffing minimums will require billions of dollars each year to hire tens of thousands of additional caregivers. CLA estimated the impact of implementing a staffing minimum of 4.1 hours per resident day (HPRD) and found:
- 94 percent of nursing homes that care for more than 900,000 residents would need to increase staffing levels in order to be in compliance with such a requirement.
- It would cost $10 billion a year and require hiring more than 187,000 nurses and nurse aides to meet the standard.
- 18 percent of residents, or more than 205,000 residents, may be at risk of displacement as facilities are forced to potentially reduce their census in order to meet the higher staffing standard.

STATE AND PUBLIC POLICY ISSUES | | |
Arizona House Committee Meets
On July 14 an Arizona House Ad-Hoc Committee on Abuse and Neglect met. This committee was formed in 2019 by House Speaker and Republican Rusty Bowers and chaired by Democrat and Assistant House Minority Leader Jennifer Longdon to protect Arizona’s vulnerable adults. The committee was formed in response to the abuse and neglect at Hacienda Healthcare where a disabled woman gave birth after being raped by a staff member.
This Committee plans to meet with various Arizona agencies and stakeholders to work on implementing its 11 recommendations to fulfill its purpose: reviewing and identifying best practices for the reporting and investigative processes to ensure the safety of vulnerable adults. The committee has a working relationship with Gov. Ducey’s Arizona’s Abuse & Neglect Prevention Task Force.
Rep. Longdon said one of the committee’s achievements is a new Arizona law that provides a statutory definition for emotional abuse and ensures emotional abuse of an adult is treated as a crime. The next committee priority is to start an audit of Arizona Adult Protective Services and then funding a program to oversee vulnerable adults.
AHCA will continue to work with the committee and other stakeholders as this process unfolds.

F919 – Resident Call System
AHCA NCAL is regularly sharing information on a particular F-tag(s) to help providers break down the ROP Phase 2 updates and Phase 3 new guidance. This week focuses on §483.90 Physical Environment – F919-Resident Call System.
CMS made changes to §483.90(g)(1)-(2) Resident Call System. The regulation states the facility must be adequately equipped to allow residents to call for staff assistance through a communication system which relays the call directly to a staff member or to a centralized staff work area from each resident’s bedside and toilet and bathing facilities.
- The guidance outlines that the call system must be accessible to residents while in their bed or other sleeping accommodations within the resident’s room. In addition, the call system must be accessible to the resident at each toilet, bath, or shower and should be accessible to a resident lying on the floor.
- To prepare, facilities should develop a process to routinely ensure the call system for residents is operational. Review the process to ensure that during a loss of power, the resident call system will be operational or ensure there is an alternate means of communicating with the staff in place. Facilities should also examine the functionality of the call system to ensure it is accessible to a resident lying on the floor.
