IRS Releases Affordability Information for Calendar Year 2023
The IRS released Rev. Proc. 2022-34 on July 29, 2022. This document provides updated ACA affordability calculations for health plans in the 2023 calendar year.
Federal Government Extends COVID-19 Public Health Emergency Through October
The Federal Government has decided to continue the nationwide COVID-19 public-health emergency through October of 2022. As a reminder, the Secretary of Health and Human Services declared a Public Health Emergency due to the COVID-19 pandemic on January 31, 2020. It has been consistently extended from that time to April of 2022.
IRS Releases Proposed Change to ACA Affordability Calculation
for Employee Dependents
On April 5, the IRS released a new Proposed Rule addressing the Affordability Calculations of the Affordable Care Act (ACA). Specifically, the rule proposes an affordability calculation for employee dependents that is separate from employees themselves.
Federal Departments of HHS, Labor, and Treasury Send Letter on Coverage of Contraception to Group Health Plans and Carriers
The Departments of Health and Human Services (HHS), Labor, and Treasury recently issued a letter to employers that sponsor group health plans and group health insurance carriers concerning their obligations to cover contraceptives on a first-dollar basis due to the Affordable Care Act's (ACA) preventive care requirements.
The Departments are concerned about complaints regarding the industry's failure to provide coverage of contraceptive services, without cost-sharing, in a manner consistent with the standards set forth by the Departments. The letter to employer plan sponsors and health insurers makes it clear that they expect plans and issuers to immediately take steps to ensure that they comply with this policy. The Departments also note they may take enforcement or other corrective actions as appropriate if they find that group plans and health insurance issuers are not in compliance.
