unrelated preemptions into one bill. There is also an amendment filed to add an
ADDITIONAL
preemption.
Of importance to cities, this bill includes the following preemptions:
- Marketing of tobacco and nicotine products - without offering substitute state regulations, essentially creating an unregulated market
- Regulations of single-use plastic straws
- Over-the-counter proprietary drugs and cosmetics (sunscreen)
- Requirement for generators
The bill also prohibits a municipality from purchasing or annexing real property within another municipality's jurisdictional boundaries, without the other municipality's consent. This provision could make it difficult to purchase property for infrastructure projects if your city provides utility services outside of your city boundary.
Rep. Santiago filed an
amendment
to CS/CS/CS/HB 1299 that would prohibit local governments from authorizing or approving a school board's impact fee if the fee results in an increase of five percent over a two-year period.
The League is OPPOSED to this amendment.
