APP WEBINAR: JUNE 1, 2022 @ 4pm PDT
Making the Law Work for 21st Century Ports:
A brief introduction to challenges we face and how the law can help us meet them
A Seminar by Law Office of Alan K. Goldstein for Association of Pacific Ports
By Zoom Wednesday, June 1, 2022 at 4p.m. PDT
Join us as Alan K. Goldstein provides insights into the challenges and solutions of today’s legal system. The agenda includes:
-
Setting the Scene: A host of factors including expansion of the Panama Canal, larger vessels (which need deeper channels and bigger berths), growing demand for U.S. energy exports, increasing dependence on automation and technology (and the cyber risk that accompanies them), climate change, geopolitical considerations and disruptions, and the new U.S. Infrastructure Investment and Jobs Act have ushered in an era of growth and complexity for Pacific ports. How can the law help advance rather than constrain ports and port authorities in trying to meet these challenges?
-
The Paper Chase: Virtually every challenge ports face includes a significant legal component and much of that legal piece of the puzzle concerns contracts and related legal documents. Those pieces of paper are not meaningless “boiler plate” but instead essential ways of minimizing and allocating risk, defining rights and obligations, facilitating expansion and combatting claims and exposures if and when things go wrong. Accordingly, it makes abundant good sense to make sure, when negotiating and drafting, that your contracts and other legal documents work for, not against you. Let’s discuss some examples.
-
Raising Revenues and the Commerce Clause: The difference between a proper port fee for services provided and an improper charge for privileges that taxes or discriminates against interstate commerce.
-
Our Litigious Society: When lawsuits happen, sovereign immunity, defense and indemnification clauses, timely investigation, appropriate liability insurance and thoughtful advance planning can aid your defense.
-
Audience Questions and Answers: “The important thing is not to stop questioning.” –- Albert Einstein

Port of Long Beach receives federal environmental impact statement on rail facility
April 18, 2022 — The U.S. Maritime Administration has issued a Final Environmental Impact Statement (EIS) and Record of Decision, approving the planned Pier B On-Dock Rail Support Facility, a Port of Long Beach project designed to enhance the flow of cargo by rail.
The EIS is available at this federal government website. Located southwest of Anaheim Street and the 710 Freeway, the planned $1.5 billion Pier B On-Dock Rail Support Facility is the centerpiece of the Port of Long Beach’s rail improvement program. It will shift more cargo to “on-dock rail,” where containers are moved directly to and from marine terminals by rail, significantly reducing trips by trucks throughout the region.

Reid Middleton wins 2022 Silver Award for Successful Fulfillment of Client/Owner Needs
April 15, 2022 — A Pier Over the Water: The public can now enjoy views out over the water along Seattle’s waterfront.
The City of Seattle needed to understand whether to repair or replace a public pier. Reid Middleton led the evaluation of Pier 62 & 63. Pier 62 was a 32,000 SF timber pier built in the 1920s. Reid Middleton suggested that the existing pier be demolished and replaced with a new pier. We completed initial design/study phase of the project to allow the City to verify the anticipated project costs and to apply for environmental permits.
