Join us as Alan K. Goldstein provides insights into the challenges and solutions of today’s legal system. The agenda includes:
  1. Setting the Scene: A host of factors including expansion of the Panama Canal, larger vessels (which need deeper channels and bigger berths), growing demand for U.S. energy exports, increasing dependence on automation and technology (and the cyber risk that accompanies them), climate change, geopolitical considerations and disruptions, and the new U.S. Infrastructure Investment and Jobs Act have ushered in an era of growth and complexity for Pacific ports. How can the law help advance rather than constrain ports and port authorities in trying to meet these challenges?
  2. The Paper Chase: Virtually every challenge ports face includes a significant legal component and much of that legal piece of the puzzle concerns contracts and related legal documents. Those pieces of paper are not meaningless “boiler plate” but instead essential ways of minimizing and allocating risk, defining rights and obligations, facilitating expansion and combatting claims and exposures if and when things go wrong. Accordingly, it makes abundant good sense to make sure, when negotiating and drafting, that your contracts and other legal documents work for, not against you. Let’s discuss some examples.
  3. Raising Revenues and the Commerce Clause: The difference between a proper port fee for services provided and an improper charge for privileges that taxes or discriminates against interstate commerce.
  4. Our Litigious Society: When lawsuits happen, sovereign immunity, defense and indemnification clauses, timely investigation, appropriate liability insurance and thoughtful advance planning can aid your defense.
  5. Audience Questions and Answers: “The important thing is not to stop questioning.” –- Albert Einstein

Business Opportunity: Marshall Islands Maritime Investment Project – Project Manager

The Government of the Republic of Marshall Islands has received financing from the World Bank toward the cost of the Marshall Islands Maritime Investment Project and intends to apply part of the proceeds for consulting services.

The consulting services (“the Services”) include provision of Project Manager services for the implementation of the Marshall Islands Maritime Investment Project (MIMIP). The Project Manager will function as head of the Project Implementation Unit (PIU). The PIU will provide the core technical and managerial support for the implementation of MIMIP activities implemented by the Republic of the Marshall Islands Port Authority (RMIPA). The Project Manager will be responsible for advising and regular reporting on all project matters, project progress and results for MIMIP activities implemented by RMIPA. He/she shall be primarily responsible for the day-to-day administration of the PIU.

Port of San Diego’s Pepper Park redesign gets $250,000 infusion from Austal USA

May 5, 2022 — The Port of San Diego’s Pepper Park redesign and improvements budget has received a $250,000 infusion thanks to Austal USA, which is operating a new ship repair facility on the National City Bayfront. The Port has designated $3.85 million in American Rescue Plan Act funding toward the Pepper Park redesign and improvements to be completed by summer 2024. Austal USA’s contribution, presented to the Port at its May 5 Pepper Park design workshop, brings the current budget to approximately $4.1 million.

“Pepper Park is already a recreational gem on our San Diego Bay waterfront. Austal USA’s $250,000 gift, on top of what we’ve already budgeted for the redesign and enhancements, will truly help to make it sparkle,” said Commissioner Sandy Naranjo, Board of Port Commissioners. “Thank you to Austal USA and all in the community who are helping us transform Pepper Park into a resource that visitors and residents will cherish for years to come.”

Port of Long Beach new Pier B on-dock rail support facility is on track

May 5, 2022 — For more than two decades, the Port of Long Beach has envisioned transforming its Pier B rail yard into a modern, high-tech on-dock rail support facility.
Now that the project has cleared the federal environmental review process, the centerpiece of the Port’s rail infrastructure improvement program can move swiftly from vision to reality.

“This milestone unlocks our access to federal funding and allows our Board of Harbor Commissioners to address the remaining local decisions needed to break ground on this critical link for expediting cargo by rail between the Port and major markets nationwide,” said Port Executive Director Mario Cordero. “The Pier B On-Dock Rail Support Facility advances all our goals for accelerating the flow of cargo: increasing on-dock rail efficiency, reducing shipping costs and shrinking the supply chain’s carbon footprint.”

Old Wine in a New Bottle: Colonial-era Warehouses Transformed into Centerpiece of Port of Keelung’s New Cultural-Creative Tourism District

May 5, 2022 — First constructed in the 1930s, Port of Keelung’s West Warehouse Nos. 2 & 3 have witnessed nearly 90 years of harbor history. In light of the heritage value and importance of these structures, Port of Keelung, TIPC launched a restoration and revitalization effort that saw these buildings repaired and faithfully restored by the end of March 2022. An invitation to bid for commercial space on the first floor of West Warehouse No. 2 is under development and will be announced in May, after the end of Keelung City’s 2022 City Expo (04/22 – 05/02).

Taiwan’s Japanese colonial authorities constructed a total of eight warehouses at Keelung Harbor in the 1930s. Warehouse Nos. 2 and 3, respectively completed in 1932 and 1934, are the only two still standing today. Until the rise in containerized shipping and air freight in the late-20th century, these warehouses handled a significant portion of Taiwan’s commercial trade with the world. The warehouses were featured in the hit movie Kano produced by Te-sheng Wei and, in June 2014, were designated as municipal heritage sites by Keelung City’s Cultural Affairs Bureau.

Celebration of World Trade Week at the Port of Hueneme Highlights Importance of Green Tech and Blue Economy

May 4, 2022 – Trade consuls from around the world, high-ranking Department of Commerce officials, local elected officials, business leaders, and maritime industry experts gathered at the Port of Hueneme to present an important program with a special focus on environment, green technology, and the economy as it relates to the marine realm.

The 10th annual World Trade Week event, “Green Tech and Blue Economy,” was held at the Port of Hueneme on May 3, 2022 and welcomed over 100 people from around the globe with an interest and involvement in international trade.
