PBM Reform Package Passes the U.S. House and Heads

to the U.S. Senate

Last week, on May 22, the U.S. House of Representatives passed the Reconciliation Bill. Included are key PBM Reforms that can greatly improve patient access and avoid PBM conflicts of interest:

• It would require pharmacy reimbursement by Medicaid managed care organizations at the same ingredient and dispensing fee rate as the state fee-for-service rate. 
• It would prohibit PBMs from spread pricing tactics in Medicaid.
• It would prohibit PBMs from being paid rebates or other compensation based on formulary decisions.

The bill is now being considered by the U.S. Senate. While there remains a lot of horse trading on the final version, the bill will pass. And because the PBM Reform package saves taxpayer money, it is almost a certainty that these reform provisions will end up in the final bill. The U.S. Senate may vote on their version of the Reconciliation Bill as early as July.
