Department of Labor Continues with Appeal of Overtime Rule Injunction
A lot has happened over the holidays, especially in regard to the federal overtime rule.  First, let's recap where employers last left off with the rule.  
On November 22, 2016, U.S. Judge Amos Mazzant in Texas issued a preliminary injunction to temporarily block the U.S. Department of Labor (DOL) from implementing and enforcing its Final Overtime Rule nationally. The new overtime rule would have required employers to start paying overtime to workers earning salaries of less than $47,476 a year.  As a result of the injunction, employers currently do not need to comply by the original December 1 effective date. 
However, the Justice Department, on behalf of DOL, filed a notice of appeal on Thursday, December 1, in the U.S. District Court for the Eastern District of Texas to defend the Obama administration overtime rule.   
More recent developments
On December 8, 2016, the U.S. Court of Appeals for the Fifth Circuit announced that it would fast-track the DOL appeal. The briefing of the appeal and oral arguments will not occur until January 31, 2017, which takes place after the presidential administration has changed. 
As of right now, the future of the rule is still extremely uncertain. President-elect Donald Trump has already threatened to scrap the measure. His nominee for Secretary of Labor, which is the top position at the DOL, is Andrew Puzder, a fast-food CEO, who is a vocal critic of the overtime rules change.  
The best thing for employers to do right now is to continue with plans they made after the rule was blocked from taking effect.
