CMS Unveils Proposed Changes to Part D Drug Policies

WASHINGTON -- The Centers for Medicare & Medicaid Services (CMS) announced several new policies aimed at lowering drug prices for Medicare beneficiaries, but critics say the savings may be quite modest and that the proposals may reduce beneficiaries' access to needed drugs.
"Foremost in our mind was the impact on patients and ensuring affordability and access to prescription drugs," CMS administrator Seema Verma said Monday on a phone call with reporters. "From day one, President Trump has made it clear that lowering prescription drug costs is a top priority ... and CMS is hard at work to make the president's vision a reality, because the status quo is unacceptable."

Janssen Sued by NJ Over Opioid Sales, Marketing Practices

The state of New Jersey has filed a lawsuit against Janssen Pharmaceuticals claiming the company used deceptive practices in the sale of two powerful opioids, Nucynta and Nucynta ER. The company is denying those claims.

FDA plans big changes to 510(k) pathway

The Food and Drug Administration (FDA) on November 26 announced that it plans to modernize its 510(k) approval pathway by pushing device manufacturers to rely on predicate devices that are not older than 10 years.
Under the existing pathway, manufacturers can pursue expedited approval for devices that are substantially equivalent to decades-old technologies.
The FDA will release a list of technologies that are based on older comparisons.


Louisiana Doctor Pleads Guilty to Conspiring to Receive Health Care Kickback Payments
A Baton Rouge, Louisiana-based doctor pleaded guilty today for his role in a scheme to receive approximately $336,000 in illegal health care kickback payments. 
Assistant Attorney General Brian A. Benczkowski of the Justice Department’s Criminal Division, U.S. Attorney Brandon J. Fremin of the Middle District of Louisiana, Special Agent in Charge C.J. Porter of the U.S. Department of Health and Human Services Office of Inspector General’s (HHS-OIG) Dallas Field Office and Special Agent in Charge Eric J. Rommal of the FBI’s New Orleans Field Office made the announcement. 
Gray Wesley Barrow, M.D., 58, of Baton Rouge, pleaded guilty to an information charging him with one count of conspiracy to pay and receive health care kickbacks. He is scheduled to be sentenced on March 1, 2019 by U.S. District Judge Brian A. Jackson of the Middle District of Louisiana, who accepted his plea today.
