ASMP Response to Instagram
On April 13, 2020, an opinion was rendered in District Court in New York regarding “embedding” an image that was available on a public Instagram account of photojournalist Stephanie Sinclair. ASMP legal council Tom Maddrey
sent a letter
signed by seven other visual associations to the CEO's of Instagram and Facebook (Instagram's parent company).
This lower cou
rt's decision effectively
makes it more acceptable for bloggers, publishers, broadcasters and others to use imagery on their sites that they do not own. And the use of the Instagram API to “embed” a user’s image on a third-party site did not constitute copyright infringement. Go

Ellen Jaskol
worked at the Los Angeles Times until becoming a newspaper photographer at the Rocky Mountain News in Denver, where she worked for 17 years. During her time at the Rocky Mountain News, the photo staff won two Pulitzer prizes. In 2010 and 2011, she travelled and worked in Afghanistan and Pakistan, photographing schools and projects for the Central Asia Institute, co-founded by
Three Cups of Tea
author Greg Mortenson.
The years spent in photojournalism have prepared her to photograph in many different settings and styles. She shoots editorial and corporate work; her clients include hospitals, restaurants, marketing/pr firms, and non-profits. She loves to collaborate and encourages an environment in which all ideas are welcome. She wants her clients to love their images and will work tirelessly until they do.

The Value of ASMP Membership
The advent of the COVID-19 pandemic is profoundly affecting photographers of every kind and now more than ever ASMP has been there for all of us. The ASMP staff and national board members are doing everything in their power to provide the necessary information and support so all photographers—not just ASMP members—can navigate through this pandemic’s turbulence.
ASMP legal counsel Tom Maddrey, and Executive Director Tom Kennedy, are conducting twice-weekly (every Wednesday & Friday) webinars to provide information about the legal and business implications of the COVID-19 pandemic and to discuss the help and support needed by photographers in the moment.
ASMP worked hard behind the scenes, contacting key Representatives and Senators, as part of advocacy efforts to ensure that the CARES Act relief package included provisions to address the needs of our photographers, people who work as the smallest of small business owners, often as sole proprietors or LLC’s, gig workers and freelancers.
