Field Law looks at:
What Does It Mean to Be “Ungovernable”?
"Ungovernability" arises when a professional demonstrates an unwillingness or inability to comply with regulatory oversight, often through repeated misconduct, lack of cooperation, or disregard for governing processes.
Courts assess multiple contextual factors, but place particular weight on whether the professional engages with and follows regulatory directions. While cancellation remains a last-resort sanction, it becomes appropriate where a professional cannot be effectively governed and therefore poses an ongoing risk to the public.
