Casual Legal Article
In a recent decision, a Justice of the Court of Queen’s Bench of Alberta determined that a municipality was liable in connection with a violent assault that occurred in the early hours of New Year’s day in 2006.
The Plaintiff was assaulted on a skywalk connecting an LRT station to a parkade, and suffered a severe concussion, multiple broken facial bones, and required numerous stitches. The Plaintiff sued the municipality claiming that, under
The Occupiers’ Liability Act
the municipality owed him a duty to ensure he was reasonably safe in his use of the skywalk.
