This amendment is necessary to clarify that towns and municipalities have explicit authority, but not obligation, to maintain Legal Trails in order to ensure that these critical transportation corridors would remain accessible. 


The recent court case in Tunbridge, in which a private landowner is suing the town, could have significant impacts on all 500+ miles of Legal Trails and the connectivity they facilitate throughout the State of Vermont. If the municipal right to manage and maintain Legal Trails is not clarified, vital recreational opportunities and community connections could be lost forever.
