The hold placed by Judge Hanen in the
Texas v. U.S. case has generated confusion about how it affects the Deferred Action for Childhood Arrivals (DACA). DACA benefits will continue, but the hold placed by Judge Hanen requires that the United States Citizenship and Immigration Services (USCIS) retrieve the 3-year Employment Authorization Documentes (EADs) issued after February 16th in order tor replace them with 2-year EADs.
For this reason, USCIS is contacting the 2,100 DACA beneficiaries with 3-year EADs issued after February 16th. There are about 900 DACA beneficiary who have yet to return their 3-year EADs.
USCIS is considering to terminate the DACA and the EADs of those individuals that received their 3-year EAD after February 16 and have not returned it to USCIS.
