Mortgage Bankers Association Supports
Federal Enactment of RON Legislation

The Mortgage Bankers Association and the Mortgage Action Alliance are calling on Congress to enact legislation that would allow remote online notarization. Senators Kevin Cramer (R-ND) and Mark Warner (D-VA) have introduced S. 3533, “The Securing and Enabling Commerce Using Remote and Electronic Notarization Act of 2020.” (The “SECURE” Act) The MBA is urging its members and Mortgage Action Alliance members to contact their Senators and ask them to support this pending legislation. On March 21, 2020, we advised our New York CATIC Title Insurance agents of an emergency Executive Order issued by Andrew Cuomo, the Governor of New York. That Executive Order authorizes notarization that uses audio-video technology, so long as certain conditions are met. For further detail about the New York Executive Order, and RON in general, please click here to read CATIC Title Insurance Company’s Agent Alert.

We will continue to advise you of any further developments with regard to executive orders and legislation related to remote online notarization, as well as any other governmental responses to the coronavirus situation.
