Executive Order Tolls Expiration of Land Use and Building Permits (CT)

On May 6, 2020, Governor Lamont issued Executive Order 7JJ, which, at Section 3, concerns the tolling of land use and building permits. The Order provides that an approval or permit issued by a municipal land use agency or official, or by a municipal building official, shall not lapse or otherwise expire during the declared state of emergency. If any such approval contains or is subject to conditions, the agency or official may issue a waiver if the permit holder is not able to abide by the conditions due to the COVID-19 pandemic. Any such waiver shall not be unreasonably withheld.

The Order also provides that this tolling of permit expirations shall not apply if the holder was in violation of the terms and conditions of the permit as of March 10, 2020, or if the holder violates such terms and conditions during the state of emergency. Further detail is set forth in the Executive Order.

This provision of the Executive Order became effective immediately, and will remain in effect for the duration of the declared state of emergency, unless earlier modified, extended, or terminated.
