Effective Monday, December 7, 2020, the Superior Court will resume printing arguable motions on Short Calendar 02 (Property/Foreclosure). Arguable motions that have been marked “ready” will be assigned a date and time for a remote hearing that will be conducted through Microsoft Teams. Despite conducting hearings remotely, parties are still obligated to present the original note and mortgage documents when moving for judgment of foreclosure. Consequently, all such documents must be uploaded through E-Services. The documents will be sealed to protect nonpublic personal information, including loan numbers, and, consequently, the documents should not be redacted or altered in any way prior to upload. Parties are still required to comply with the mortgage foreclosure Standing Order and affidavit requirement dated September 24, 2020. [See our October 2nd agent alert.]
On December 1, 2020, Governor Lamont signed Executive Order 9O to amend Executive Order No. 7G and Executive Order No. 9L as they relate to the suspension of certain deadlines and requirements applicable to Supreme and Appellate Court operations and also offers of compromise pursuant to General Statutes §§ 52-192a and 52-193 through 52-195. Agents should note that the suspension of requirements and deadlines will expire no later than December 15, 2020. Included in the modification are statutory time requirements, statutes of limitation, and deadlines that affect Supreme or Appellate Court matters, including those governing Superior Court filings, hearings, or decisions relating to Supreme Court and Appellate Court matters. Additionally, the suspension of deadlines relating to service of process, court proceedings, or court filings for Supreme and Appellate Court matters will also terminate. Lastly, the time limits related to offers of compromise will resume as of December 15, 2020.
