Kettler Named New Director of ISDA
Last Friday, Indiana Lt. Governor Suzanne Crouch announced Bruce Kettler as the new director of the Indiana State Department of Agriculture. Bruce is currently the director of public relations for Beck's Hybrids and will begin his new post on January 8, 2018. He has an extensive background in the agriculture and agribusiness industry and will be a great leader for Indiana Agriculture. Check out the policy newsletter for the full press release.

2017 NGFA Country Elevator Conference
ACI President Amy Cornell and ACI Board Member Mike Schweickert, JP Morgan Chase, are currently attending the NGFA Country Elevator Conference in Louisville, Kentucky.  Today began with a  "30,000 ft. view" of the world economy and then attendees will move to four rounds of interactive breakout sessions focusing on merchandising, operations, management, legal, safety, and/or marketing.

Information Regarding Agriculture Production Tax Exemptions
ACI reminds agribusinesses that certain transactions are sales tax exempt.  The Indiana Department of Revenue has published guidance - click here to view.  The rules are complex and are fact sensitive.  You should consult your tax advisor if you have questions based on the specific facts and situations related to your particular business.
ELD Extension Not Applied to Farm Supply Retailers

The Federal Motor Carrier Safety Administration new Electronic Logging Device requirements go into effect December 18. ELD systems synchronize with a vehicle's engine to more easily and accurately record driving time for hours of service requirements. The ELD rule applies to most motor carriers and drivers currently required to maintain records of duty status (RODS) per Part 395, 49 CFR 395.8(a). To ease the transition to ELDs, FMCSA has announced that any violations cited during the time period of December 18 to April 1, 2018, will only receive a fine and not count against a carrier's Safety Measurement Systems (SMS) scores.

FMCSA also announced that in advance of the Dec. 18, 2017, implementation of the ELD rule, and to further facilitate the transition to the rule by motor carriers, the agency will be providing guidance related to enforcement procedures during the ELD transition. These will include a 90-day temporary waiver from the ELD requirement for transporters of agricultural commodities, formal guidance specifically pertaining to the existing Hours-of-Service exemption for the agricultural industry, and guidance on the "personal conveyance" provision.
The 90-day waiver will NOT include transporters of farm supplies.
ARA remains concerned with the impact this new regulation will have on the agricultural industry and has submitted a petition to the DOT seeking a complete exemption for agricultural retailer and distributors from this unfunded federal mandate. Indiana Attorney General Calls for Delay of Implementation of New Requirements for ELDs
On Wednesday, the Attorney General of Indiana sent a letter to Federal Motor Carrier Safety Administration calling on the agency to delay implementation regarding Electronic Logging Devices (ELDs) by commercial drivers. This is a major blow to the agency's claim that the states are fully prepared for the December 18 th implementation deadline. Please click HERE to read the letter.
