From the President

It has been an interesting month since the last President’s message. The membership is working hard volunteering their time interviewing judicial candidates and planning for upcoming events like the October 3 CLE with Justice Kennedy (free to members), followed by a recognition ceremony honoring Buck Gearinger and his family for their donation to the Akron Bar Foundation. Let’s do our best for a solid turnout to honor Buck and thank the Gearinger family. Other events include a series of great CLE seminars, the Bocce Tournament on September 26, and the 2018 Bradford M. Developments in Internet Legal Services

Citing nine individual rules within the Rules of Professional Conduct and Gov.Bar R. XVI, the Board of Professional Conduct of the Supreme Court of Ohio issued Advisory Opinion 2016-3 Lawyer Participation in Referral Services on June 3, 2016. 
The Board concluded that:

A lawyer’s participation in an online, non-lawyer-owned legal referral service, where the lawyer is required to pay a “marketing fee” to a non-lawyer for each service completed for a client, is unethical. A lawyer must ensure that the lawyer referral service does not interfere with the lawyer’s independent professional judgment under Prof.Cond.R. 5.4. A lawyer is responsible for the conduct of the non-lawyers of the service (Prof.Cond.R. 5.3), as well as the advertising and marketing provided by the service on the lawyer’s behalf. Prof.Cond.R. 7.1, 7.2, 7.3. Additionally, a fee structure that is tied specifically to individual client representations that a lawyer completes or to the percentage of a fee is not permissible, unless the lawyer referral service is registered with the Supreme Court of Ohio. Prof.Cond.R. 1.5, Gov.Bar R. XVI.

Proposed State Issue 1 Worries Ohio Chief Justice; Will Reduce Prison Costs Says Supporter

The only statewide issue on the November 6 ballot in Ohio is State Issue 1 which proposes a Constitutional amendment t hat w ould require low-level drug offenders be charged with misdemeanors, not felonies. The topic came up at September's meeting of the Common Pleas, Municipal, and Appellate Courts committee where concern about the possible impact on local drug courts was evident.

The Akron Bar Association, in cooperation with other members of the Ohio Metropolitan Bar Association Consortium (OMBAC), is pleased to announce a new and improved platform for all of your self-study/online CLE needs. 


If you have not logged into our online CLE catalog since May 1, 2018, then - before you can complete a purchase - you must first reset your password using the email address associated with your old online CLE account.

Courses Completed Prior to 5/1/2018:
Your completion information and certificates of attendance have been transferred over to your new account and can be viewed after you log-in.

However, if you do not see completion information and certificates of attendance for programs you completed prior to May 1, 2018, you should:

  1. Go to https://ombac.ce21.com/
  2.  Log into your Legacy Account using your email address associated with your old OMBAC account.
  3. If you have not logged into the OMBAC site since May 1, 2018, then you need to reset your password using the email address associated with your old OMBAC account.

Stanley Burt Schneiderman
July 17, 2018

Stan graduated from Kent State University and obtained his JD as president of his law class at The  Ohio State University . He served for two years in the U.S. Air Force. He worked as a personal injury attorney for more than 50 years, was active in the Ohio Academy of Trial Lawyers, and served on the executive committees of the Akron and Ohio State Bar Associations.
