DDTC Rescinds Prior Notice Regarding
Expired Form DSP-83

Today the Directorate of Defense Trade Controls (DDTC) announced that effective immediately, it will continue to process expired Forms DSP-83 Nontransfer and Use Certificate.

Effective IMMEDIATELY any expired DSP-83 forms the Department receives will be processed. 

The Department, in consultation with the Office of Management and Budget, has updated its policy regarding the DSP-83. While the Department cannot mandate the use of an expired form, an individual or entity may voluntarily submit such a form and it can be processed as long as it contains all of the information and certifications required by the current, unexpired form. Since the DSP-83 to date has not been substantially amended, the Department will continue to accept expired forms. 

That said, the Department strongly urges all individuals and entities that are not using the current form provided by the Department to implement the new form no later than October 1, 2016 in order to avoid any confusion during future revisions. 

The Notice published on this site on May 6, 2016, is rescinded. Anyone who received a proviso directing upload of a new DSP-83 form in accordance with the rescinded Notice can hereby disregard the proviso by citing this revised notice. .
