KICK-OFF AUG. 9, 2017

We are pleased to announce our new Wednesday Webinars on the federal firearms laws. Beginning on August 9, 2017, we are offering one-hour webinars every month on the Gun Control Act, National Firearms Act, and firearms and ammunition excise tax. Webinars will be given live via the GoToTraining platform so attendees may learn from the comfort and convenience of their own desk. The cost for each webinar is $150 per attendee.  
 
Topics and dates for 2017 are below. The topics and dates for 2018 will be released in the Fall.

Aug. 9, 2017 (2-3 pm Eastern) - Introduction to the Gun Control Act
 
We will take attendees through the history of the federal firearms laws beginning with the Revenue Act of 1918, the National Firearms Act of 1934, and the congressional and public debate leading to enactment of the Gun Control Act of 1968. Attendees will gain an understanding of law enforcement concerns that lead to enactment, the different versions of the bill considered by Congress, and the political pressure that finally resulted in enactment. The webinar will also cover the basic structure and content of the statute. The webinar will be a valuable review for compliance professionals who regularly deal with GCA issues and individuals who are new to this complex area of the law.
 
Sept. 13, 2017 (2-3 pm Eastern) - Definition of "Firearm" Under the Gun Control Act

In this webinar, we will focus on what constitutes a "firearm" under the Gun Control Act. The presentation will include discussion of "frame or receiver;" "firearm muffler or silencer;" "destructive device," "antique firearm," "rifle," and "shotgun." We will also address the meaning of the term "weapon" and items that are not regulated under the statute because they fall outside this term. We will address unfinished items (e.g., "80 percent receivers") and challenges in determining when they reach a stage of manufacture where they are regulated as "firearms" under the Gun Control Act. The webinar will be helpful for licensed manufacturers, licensed importers, and licensed dealers to assist them in determining which items are controlled under the statute
 
Oct. 11, 2017 (2-3 pm Eastern) - Basics of Importation Under the Gun Control Act

This webinar will address the import controls of the Gun Control Act and the types of firearms that may be lawfully imported. It will address the "sporting purposes" test of the statute, importation of surplus military firearms, and imports for government agencies. We will also cover the process of obtaining an import permit from ATF's Firearms and Explosives Imports Branch. This webinar will help licensed importers and their employees.
 
Nov. 8, 2017 (2-3 pm Eastern) - Introduction to the National Firearms Act
 
This webinar focuses on the history of the National Firearms Act (NFA) and provides a basic overview of its provisions. We will address the crime problems during Prohibition that lead to enactment of the NFA, the 1968 amendments, the deactivated war trophy program, and the differences between firearms regulated under the GCA and the NFA. The webinar will also provide an overview of the taxing and registration provisions of the statute. This webinar will be helpful for all federal firearms licensees and their employees.
 
Dec. 6, 2017 (2-3 pm Eastern) - Introduction to Firearms and Ammunition Excise Tax (FAET)
 
This webinar will provide an overview of the manufacturers excise tax imposed on firearms and ammunition by 26 U.S.C. 4181. We will address the differences between the definitions of "firearm" and "shells and cartridges" under the Gun Control Act and the regulations of the Alcohol and Tobacco Tax & Trade Bureau. We will also address the tax on use, filing of returns, and how to determine the taxable sale price. We will address the definitions of "manufacturer" and "importer." This webinar will be helpful for new manufacturers and importers of firearms and ammunition. It will also be a useful review for more experienced industry members .
 
About the Instructor - Teresa G. Ficaretta, Esq., Partner at Reeves & Dola, LLP

Teresa Ficaretta joined Reeves & Dola, LLP in 2013 after serving more than 28 years at the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF). In her positions as Deputy Chief Counsel and then Deputy Assistant Director of Enforcement Programs and Services at ATF, Ms. Ficaretta built her knowledge and expertise in ATF's administration and enforcement of the federal firearms and explosives laws. Ms. Ficaretta advises firearms, ammunition and explosives manufacturers, importers and dealers on compliance matters arising under the federal firearms and explosives laws. She also advises clients on the Firearms and Ammunition Excise Tax (FAET) regulations of the Tax and Trade Bureau (TTB). She regularly counsels clients in designing and implementing effective federal firearms and explosives compliance programs, and provides compliance training sessions.
