Quick Reference Guide to Property-Based Regulations
Kevin Baldwin
Partner, Daley Mohan Groble and ARDA Law Section Chair
Real estate management requires an understanding of economic principles and a certain artistic approach in dealing with persons and other interests involved.  Beyond those having a direct interest in our leased properties and development sites, every property owner should understand the regulatory structure in place applicable to a particular project or site.

"It will be of little avail to the people...if the laws are so voluminous that they cannot be read, or so incoherent that they cannot be understood..." - James Madison

While the rail industry, including those real estate holdings used or reserved for railroad purposes, is subject to the exclusive regulatory authority of the Surface Transportation Board, it does not mean that property managers are entirely exempted from having to deal with regulations outside of Federal railroad laws.  Some, such as Federal environmental regulations, are held in full force and effect against railroad properties, and will come into play regardless of the parcel location or scope of the project.  Others may apply indirectly, such as the necessity for trucking and transportation permits for local construction projects.  And most managers, at one time or another, have tales of dealings with overzealous municipalities who seek to involve themselves in rail interests for various reasons.
2018 ARDA Preview: Building on Our Foundation

For 2018, ARDA will be focusing our effort and events around the theme of "Building on Our Foundation." This theme reflects the long history of the railroad industry and our aim to look at future opportunities that take advantage of our current position and strengths. To help focus on our theme we have chosen two event host cities with a long history in railroading and promising outlooks for future growth: Savannah, GA and New York, NY.

2018 Executive Forum - Savannah, GA - February 8-9, 2018

The 2018 Executive Forum will begin at Noon on Thursday, February 8, 2018, at the Charles H. Morris Center in Downtown Savannah, GA. Registration and more details on the Executive Forum will be published on the ARDA website in September.

2018 Annual Meeting - New York, NY - June 10-12, 2018

The 2018 Annual Meeting will begin with a reception on the afternoon of Sunday, June 10, 2013, with the main Annual Meeting program beginning the next day. The majority of Annual Meeting events will be held at the City University of New York Graduate Center, located in Midtown Manhattan. More details on the Annual Meeting will be available early in 2018.
2017 Annual Meeting in Memphis

The 2017 ARDA Annual Meeting in Memphis was a great success. Attendees enjoyed a program featuring a wide range of speakers discussing a number of timely issues within the railroad industry. The Annual Meeting, our final event of the "Get Connected" year, also featured a reception on the Mississippi River aboard the Memphis Queen III, and the President's Dinner at the Skyline Lounge and rooftop of the Peabody Hotel.

The Silent Auction raised over $2,500, which will be matched by ARDA, to make $5,000 available for our new scholarship program. Details on the ARDA scholarship will be made available in advance of the 2018 Executive Forum in Savannah.

Thanks to all of our attendees, speakers and sponsors who made it to Memphis to "Get Connected."

More details on the 2017 Annual Meeting can be found on our website at www.amraildev.com/2017annualmeeting. Presentation slides are available on our website for all ARDA members.
