MOUNT VERNON

It has come to our attention that the City of Mount Vernon's Finance office is closed and is currently not processing the Mount Vernon Real Property Transfer Tax Returns (the "Mt. Vernon RPT"). Inasmuch as the Westchester County Clerk's Office will not record a deed pertaining to a property in the City of Mount Vernon without the Mt. Vernon RPT stamped as having been paid, this effectively means that we are currently unable to record deeds pertaining to properties located in the City of Mt. Vernon. 
If you have a transaction that you are working on in the City of Mount Vernon, please be sure to call or email our underwriting counsel to discuss the implications before moving forward with the transaction.

Underwriting Tips

Due to COVID, even today, we are seeing that most COUNTIES, COUNTY CLERKS, AND COURTS are running with enormous limitations. We are still seeing delays on search results from all counties and depending on the municipality, departmental searches can take up to 30 days.
In addition, if your file involves the sale of the property from an ESTATE most Surrogates Courts are either closed or running very limited. As such our examiners are generally not able to access Surrogates Court records. As a practice tip if your file involves an ESTATE selling real property please obtain or have counsel for the Seller obtain the estate file and send to us for review so we can quickly and efficiently underwrite your file.
OneTitle National Guaranty Company put into Liquidation

By Order dated October 6, 2020, the Supreme Court, New York County granted DFS Commissioner Lacewell's request and placed OneTitle National Guaranty Company into liquidation. 
OneTitle National Guaranty Company was a discounted rate underwriter in NY from 2015-2019 and not part of TIRSA and their rate guidance.
Please note that if you or your clients have obtained a title policy from OneTitle National Guaranty Company, you need to discuss your liability going forward. As of November 5th, 2020 the policy holder is no longer insured and no other title underwriter will be able to  accept any letter of indemnity, escrow benefit letter or prior policy from OneTitle National Guaranty Company under the Mutual Indemnity Agreement, or for any other use as clearance for title objections.  
This could make title clearance for a sale of the insured property difficult. If you or your client have a policy from OneTitle National Guaranty Company, please contact counsel and we will discuss and advise you of your possible options.
