New Emergency Bill Would Virtually Eliminate Independent Contractors
Montgomery County Senator Roger Manno has introduced a bill that would vastly expand the requirements for an individual to be considered an independent contractor. By strategic use of the word "and," the bill requires that if the individual does not meet all 18 criteria, outlined under the traditional A,B,C rule, he or she is considered an employee for the purposes of unemployment insurance. It takes the criteria currently used in part by the Department of Labor Licensing and Regulation to determine an individual's status and applies all of them to the determination. If enacted, the bill would make most freelance photographers, graphic designers, sales persons, and many others employees of the companies for which they do contract work. As such, companies would have to report and pay unemployment insurance on these individuals, and would be subject to unemployment claims on the basis of the new law. This bill is a drastic over-reach by labor and employment groups. It is particularly worrisome because it has the support of Senator Thomas (Mac) Middleton, chair of the Senate Finance Committee. A hearing is scheduled for tomorrow at 1 p.m. in that committee. GSSCC is working with the Maryland Chamber and other business groups to stop this bill before it is heard, or at least before a vote can be taken. Here is a link to the bill. 

Bill to Bar Employers from Seeking Candidates' Salary History May be Stalled
Legislation that would prohibit an employer from inquiring into or obtaining an applicant's salary history has been passed by the House, but has, at least temporarily, stalled in the Senate Finance Committee. A hearing scheduled for this week was cancelled. A companion bill was introduced in the Senate by Senator Susan Lee from Montgomery County had received an unfavorable report from Senate Finance earlier. The House bill had been amended to delete sections that would have required employers to post the salary for an open position in any job announcements or other information.

Hearing for Non-compete, Conflict of Interest Bill Cancelled
A hearing scheduled for this week was cancelled on legislation that would restrict the ability of an employer to enforce non-compete and conflict of interest clauses and to protect client lists or ot her company information from being shared with competitors by former employees. That means it is unlikely that this bill , introduced by Montgomery County Delegate Al Carr, will move further this year.
