Overtime & FLSA Overtime

The Fair Standards Labor Act requires that non-exempt employees are paid a 0.50 premium for hours worked in excess of 40 per workweek. Please note that state law, local laws, and/or collective bargaining agreements can put stricter rules in place.

If you pay an employee the same rate, this calculates to 1.50x for overtime pay. If you have employees with multiple rates of pay in the same workweek, you must use the Regular Rate of Pay (blended rate) when calculating overtime earnings. ADP Workforce Now supports FLSA Overtime.

Let's put together a Disaster Readiness Plan

As a reminder California’s Civil Rights Division (CRD) has released updated guidance and resources to reflect recent changes to the pay data reporting requirements for employers with 100 or more employees. The changes were a result of the enactment of Senate Bill 1162.

Illinois has enacted legislation (Senate Bill 208) that will require employers to provide employees with up to 40 hours of paid leave that they may use for any reason. Senate Bill 208 takes effect January 1, 2024.
