DEI - The Monster in America's Closet?


On March 14th, the 4th U.S. Circuit Court of Appeals reinstated two Executive Orders that a Maryland federal judge previously enjoined in whole or in part.


Chief Judge Diaz wrote a concurring opinion pondering whether employers' diversity, equity, and inclusion programs are the "monster" in American's closet.

Will ERG's Survive DEI Challenges?


Employee Resource Groups or ERG’s are voluntary, employee-led groups of like individuals who lend support to one another and foster a sense of belonging (DEIBA) in the workplace. Common ERG’s are those based on sex, race, parental status, and more.

RIF Reminders & Resources


I have heard from many clients and colleagues over the last few months who are implementing or are contemplating a reduction in force (RIF). Ipse Dixit What?! Judge Rules -

Employees Need to Document Too!



HR professionals are frequently reminding managers to document, document, document! The 7th U.S. Circuit Court of Appeals (covering IL, IN, WI ) recently ruled that an employee bringing a wage claim has a duty to do the same. Ipse Dixit won't do.

Court Rules on Question of ADA Reasonable Accommodation


Is an employee who can perform the essential functions of a job without a reasonable accommodation still entitled to one under the Americans with Disabilities Act?

ADA Interactive Dialogue Takes Two!


An employee self-reports that he is prescribed amphetamines and opioids. He subsequently fails your random drug test due to those positive results. Your Medical Review Officer is unable to reach the employee to request a copy of his prescriptions. When the employee is suspended, he sues. Did the employer violate the ADA when it suspended him?
