We have a Golf Course that also has a snack bar/caf�. Which Industrial Welfare Commission order applies to our caf�? Is it different than the Golf Course?
Answer:
Industrial Welfare Commission (IWC) Order 10, Amusement and Recreation Industry, covers Golf Courses and other businesses incidental to the Main Business. Unless the caf� is operated as a separately organized and managed entity, it also will be covered by IWC Order 10.

City of Palm Springs & Bureau of Tourism Launch New Film Friendly Incentive Program and Web site
Filming in Palm Springs is now easier than ever thanks to the new City of Palm Springs "Film Friendly" Incentive Program and a Virtual Film Office web site, launched by the Palm Springs Bureau of Tourism.
The new web site, www.psfilmfriendly.com, is for filmmakers and producers sourcing locations in Palm Springs for upcoming movies, television shows, commercials, and advertising photo shoots. The site features an image library, a free film permit application and a helpful directory of film-friendly locations in Palm Springs.
"We created this online resource to showcase our diverse locations and the benefits of filming in Palm Springs," said Mary Jo Ginther, Director of the Palm Springs Bureau of Tourism. "Palm Springs has always been "film friendly" and we are now taking it to the next level. From small filmmakers to Hollywood hot shots, we are here to help make their projects come to life."
The City of Palm Springs recently launched a new "Film Friendly" Incentive Program, which includes the waiver of film permit fees and a limited quantity of $5,000 grants, either in cash or in-kind services, for production expenditures in the city that total a minimum of $25,000.
On Wednesday, March 6, the Palm Springs City Council presented the first $5,000 grant to Barry Barnholtz, the producer of "Hidden Away," a new Hollywood production that was recently filmed in Palm Springs starring Emmanuelle Vaugier, Sean Patrick Flanery and Elisabeth Rohm, which will premiere at the Annenberg Theater this June.

Since the 1930s, Palm Springs has been a set for many movies, commercials and photo shoots. Most recently, Academy Award winning actors Michael Douglas and Matt Damon were in Palm Springs shooting scenes for the new HBO movie, "Behind the Candelabra," about the life of former Palm Springs resident Liberace. In addition, the City of Palm Springs was the premier destination for the 9th season of "Occupation Double," the top rated reality television series in Montreal, Quebec, Canada.
"Just a two hour drive from Hollywood, Palm Springs is an easy and naturally beautiful location destination for filmmakers," said Mayor Steve Pougnet. "I want to thank the Palm Springs Bureau of Tourism for their continued efforts in promoting our destination and there is no doubt in my mind the new Film Friendly Incentive Program and Web site will further boost the city's reputation as a great place to produce movies and film."

City of Palm Springs to Celebrate
Upgraded Electric Vehicle Charging Stations
at Tuesday, April 2 Ribbon Cutting

As Palm Springs continues on its path to becoming a more sustainable community, Mayor Steve Pougnet and members of the City Council will celebrate the upgrade of 10 electric vehicle charging stations at a special ribbon-cutting on Tuesday, April 2.
The 1 p.m. event will be held at the location of two charging stations behind City Hall near the Palm Springs Dog Park. The other upgraded, faster-charging stations are located at Coachella Valley Economic Partnership headquarters across from City Hall, Palm Springs International Airport, the Palm Springs Public Library and the City's fleet fueling area. The EV charging stations are FREE and open to the public.
The upgrades were paid for thanks to a $40,000 grant from the state's "ReConnect California Program."
"These stations offer faster charging and will help make the dream of driving electric vehicles a reality for Palm Springs residents interested in going green," said Mayor Steve Pougnet. For more information about green programs in Palm Springs, visit YourSustainableCity.com

Private Business
Private businesses are subject to 17 IWC orders regulating wages, hours and working conditions (such as meal periods, overtime, alternative workweeks, etc.) each with differing nuances, exceptions and exemptions that pertain to that particular business.
When determining which IWC order applies, follow a process of elimination. The orders are classified as either an industry order or an occupational order, and if an industry order exists for your type of business, it takes precedence over the particular occupation an employee is performing.
One must first review the descriptions of covered businesses in each order that contains the word "industry or industries" in the title. There are 12 orders identified as industries orders (1,2,3,5,6,7,8,9,10,11,12,and 13) and five as occupational orders (4,14, 15, 16, and 17). Occupational orders apply only when a business is not covered by an industry order.
Mixed Business
Mixed businesses require an assessment of the main purpose of the business and applying the order which corresponds to that purpose. There may be instances where a multipurpose business has two or more corporate entities operated for different purposes and the management is separately organized at all levels. In this case, two separate IWC orders may be appropriate.
The Division of Labor Standards Enforcement offers the following examples of coverage situations:
- IWC Order 1 (Manufacturing Industry) applies to an office assistant employed by a company that builds automobiles because the company is covered by an industry order.
- IWC Order 4 (an Occupational Order) applies to an office assistant employed in a law firm because a law firm is not covered by an industry order.
- A business's main purpose is operating a warehouse and incidental thereto the business employs a separate sales staff to sell goods. IWC Order 9 covers this operation even though sales are covered under IWC Order 7 because the main purpose of the business is to operate a warehouse.
- A retail department store (IWC Order 7) owns a restaurant (IWC Order 5) that is located on the department store premises, but is operated as a separate corporate entity. These businesses are covered by different industry orders because they are operated for different business purposes, and the management is separately organized at all levels.
